Preliminary determination of circumvention - antidumping and countervailing orders on certain vertical shaft engines between 99cc and up to 225cc, and parts thereof from the People's Republic of China (A-570-124; C-570-125).

Plain-English explanation

CSMS 2272404 is a U.S. Customs and Border Protection (CBP) Cargo Systems Messaging Service bulletin (trade policy), published on September 29, 2022. It carries the official CBP guidance brokers and importers must follow for the topic — "Preliminary determination of circumvention - antidumping and countervailing orders on certain vertical shaft engines between 99cc and up to 225cc, and parts thereof from the People's Republic of China (A-570-124; C-570-125).". It links to 2 AD/CVD cases in Tandom's catalog. CSMS messages are the operational layer between Commerce determinations and at-the-border collections: when Commerce publishes a new rate, scope ruling, or instruction, CBP turns it into a CSMS that ACE/ACS systems and brokers act on.

1. On 09/29/2022, Commerce issued a preliminary determination that dual-piston engines with a single, common combustion chamber, of the type designed by FNA Group, Inc., produced in and exported from China (products covered by the inquiry) are circumventing the antidumping and countervailing duty orders on certain vertical shaft engines between 99cc and up to 225cc, and parts thereof (small vertical engines) from the People's Republic of China (China) (A-570-124; C-570-125). See 87 FR 59059. 2. Specifically, Commerce preliminarily determined that products covered by the inquiry are covered by the scope of the orders because they constitute later-developed merchandise. 3. This preliminary circumvention determination is applicable on a country-wide basis, regardless of foreign producer, exporter, or importer. 4. Suspension of Liquidation 4a. Continue to suspend liquidation of entries of products covered by the inquiry that are already subject to the suspension of liquidation under the antidumping and countervailing duty orders on small vertical engines from China in accordance with message 2118401, dated 04/28/2022. 4b. For all entries of products covered by the inquiry not already subject to the suspension of liquidation, CBP shall suspend liquidation, of shipments entered, or withdrawn from warehouse, for consumption on or after 04/25/2022. CBP shall require, for such entries, a cash deposit at the applicable rates in effect on the date of entry. 4c. Entries of products covered by subparagraphs 4a and 4b should not be liquidated until specific liquidation instructions are issued. Any entries which are set for liquidation must be unset immediately. 5. In accordance with 19 CFR 351.226(l)(5), this instruction does not affect or otherwise limit CBP's independent authority to take any additional action with respect to the suspension of liquidation or related measures. 6. If there are any questions by the importing public regarding this message, please contact the Call Center for the Office of AD/CVD Operations, Enforcement and Compliance, International Trade Administration, U.S. Department of Commerce, at (202) 482-0984. CBP ports should submit their inquiries through authorized CBP channels only. (This message was generated by OII: PG.) 7. There are no restrictions on the release of this information. Is the CBP CSMS the legally binding instruction?

Yes — for at-the-border filing and entry collection. CSMS messages translate Commerce's Federal Register determinations into operational CBP instructions that ACE/ACS systems and brokers execute. The Federal Register notice is the underlying legal authority; the CSMS is the operational implementation. Both should be read together when reconciling a rate or scope change.
