Archer Daniels Midland Company, Civil Action No. 03–2066 HAB. The First Amendment modifies the Consent Decree in this case, which resolved the claims alleged by the United States and Plaintiff-Interveners for violations of the Clean Air Act, including 42 U.S.C. 7470–7492 and certain implementing federal and state regulations at 52 seed and grain processing plants of the Defendant, Archer Daniels Midland Company (‘‘ADM’’), located in 11 states. Certain issues involving the implementation and compliance with emissions limits for volatile organic compounds (‘‘VOC’’) have arisen with respect to ADM’s plants in Marshall, Minnesota and Columbus, Nebraska. Under the Consent Decree, ADM will perform a substitute project to reduce pollutants at the Marshall, Minnesota plant (the replacement of two coal-fired boilers with a natural gas boiler), and will be responsible for an offset of VOC emissions at a facility owned by Malnove Incorporated of Nebraska, located in Omaha, Nebraska (the removal of a high-VOC emitting rotogravure printing press and its replacement with a replacement low- VOC emitting press, or no replacement at all). At the time of lodging, the replacement of the two coal-fired boilers at the Marshall, Minnesota facility and the dismantling of the rotogravure printing press have already been accomplished. In addition, the First Amendment modifies the original Consent Decree by allowing partial terminations of the Consent Decree for those ADM facilities that have completed all of the compliance obligations set forth in the Consent Decree. The parties have agreed that ADM has met all Consent Decree requirements for each of the facilities listed in Appendix A to the Consent Decree, and as such the Consent Decree will be terminated in part as to those facilities. In this action, the United States filed a complaint under the Clean Air Act alleging violations at the Kapa’a and Kalaheo Sanitary Landfill (‘‘Landfill’’) located on the island of Oahu in Hawaii. The United States’ complaint alleges violations for the City and County of Honolulu’s (‘‘CCH’’) failure to timely submit a design plan for a gas collection and control system (‘‘GCCS’’) and failure to timely install and operate a GCCS. The consent decree requires CCH to pay a civil penalty in the amount of $875,000 and to implement a Supplemental Environmental Project comprised of the installation and operation of a photovoltaic system at its waste-to-energy facility located on Hanua Street, Kapolei, Hawaii. The consent decree states that, during the period of the negotiations of this consent decree, CCH submitted a GCCS design plan approved by EPA for the Landfill, installed and commenced operation of the GCCS, developed a startup, shutdown and malfunction plan, and submitted a complete application for a Title V covered source permit. These rules, including electronic filing requirements via Enforcement and Compliance’s Antidumping and Countervailing Duty Centralized Electronic Service System (‘‘IA ACCESS’’), can be found at 19 CFR 351.303. 1 This notice serves as a reminder that any party submitting factual information in an AD/CVD proceeding must certify to the accuracy and completeness of that information. 2 Parties are hereby reminded that revised certification requirements are in effect for company/ government officials as well as their representatives in all AD/CVD investigations or proceedings initiated on or after August 16, 2013.3 The formats for the revised certifications are provided at the end of the Final Rule. The Department intends to reject factual submissions if the submitting party does not comply with the revised certification requirements. On April 10, 2013, the Department published Definition of Factual Information and Time Limits for Submission of Factual Information: Final Rule, 78 FR 21246 (April 10, 2013), which modified two regulations related to antidumping and countervailing duty proceedings: the definition of factual information (19 CFR 351.102(b)(21), and the time limits for the submission of factual information (19 CFR 351.301). The final rule identifies five categories of factual information in 19 CFR 351.102(b)(21), which are summarized as follows: (i) Evidence submitted in response to questionnaires; (ii) evidence submitted in support of allegations; (iii) publicly available information to value factors under 19 CFR 351.408(c) or to measure the adequacy of remuneration under 19 CFR 351.511(a)(2); (iv) evidence placed on the record by the Department; and (v) evidence other than factual information described in (i)–(iv). The final rule requires any party, when submitting factual information, to specify under which subsection of 19 CFR 351.102(b)(21) the information is being submitted and, if the information is submitted to rebut, clarify, or correct factual information already on the record, to provide an explanation identifying the information already on the record that the factual information seeks to rebut, clarify, or correct. The final rule also modified 19 CFR 351.301 so that, rather than providing general time limits, there are specific time limits based on the type of factual information being submitted. These modifications are effective for all segments initiated on or after May 10, 2013. Please review the final rule, available at http:// enforcement.trade.gov/frn/2013/ 1304frn/2013-08227.txt, prior to submitting factual information in this segment. To the extent that other regulations govern the submission of factual information in a segment (such as 19 CFR 351.218), these time limits will continue to be applied. On September 20, 2013, the Department modified its regulation concerning the extension of time limits for submissions in antidumping and countervailing duty proceedings: Extension of Time Limits, 78 FR 57790 (September 20, 2013). The modification clarifies that parties may request an extension of time limits before a time limit established under part 351 of the Department’s regulations expires, or as otherwise specified by the Secretary. In general, an extension request will be considered untimely if it is filed after the time limit established under part 351 expires. For submissions which are due from multiple parties simultaneously, an extension request will be considered untimely if it is filed after 10:00 a.m. on the due date. Under certain circumstances, the Department may elect to specify a different time limit by which extension requests will be considered untimely for submissions which are due from multiple parties simultaneously. In such a case, the Department will inform parties in the letter or memorandum setting forth the deadline (including a specified time) by which extension requests must be filed to be considered timely. This modification also requires that an extension request must be made in a separate, stand-alone submission, and clarifies the circumstances under which the Department will grant untimely- filed requests for the extension of time limits. These modifications are effective for all segments initiated on or after October 21, 2013. The required contents of the notice of intent to participate are set forth at 19 CFR 351.218(d)(1)(ii). In accordance with the Department’s regulations, if we do not receive a notice of intent to participate from at least one domestic interested party by the 15-day deadline, the Department will automatically revoke the order without further review.4 If we receive an order-specific notice of intent to participate from a domestic interested party, the Department’s regulations provide that all parties wishing to participate in a Sunset Review must file complete substantive responses not later than 30 days after the date of publication in the Federal Register of this notice of initiation. Commercial Setting In 2012, about 260,000 visitors from Russia traveled to the United States. The forecast is for the number of Russians visitors to the United States to reach nearly 500,000 per year by 2018. With a population of over 140 million, Russia is the ninth most populous country in the world and is a huge market for outbound travel. Sustained economic growth, low unemployment and rising personal income levels mean that more Russians are able to travel more often and to long- haul destinations, such as the United States. According to the United Nation’s World Tourism Organization, Russians are among the top tourism spenders in the world, ranking number five and spending an estimated $42 billion in 2012. The vast majority of Russians visit the United States for holidays and to see family and friends. Russians enjoy shopping, dining out, sightseeing in cities, experiencing amusement and theme parks, and visiting historical places. It is noteworthy that nearly 40% of Russians who visited the United States in 2012 were first-time visitors. The average income of Russians visiting the United States is approximately $60,000, which means they have disposable income to spend on shopping, dining and leisure activities. Also, the continued strength of the Euro and British Pound against the U.S. dollar has helped make travel to the United States more attractive and affordable for Russian travelers. For Russians, outbound travel is both a vital part of doing business and a trendy form of leisure holidays. Russians experience a very cold winter each year, and they are always searching for sunny and dry destinations for their holiday adventure. A significant development is that more airlines, both U.S. and international, have launched non-stop service connecting Moscow with U.S. destinations. Delta Airlines, Aeroflot Russian Airlines, Transaero, and Singapore Airlines all offer direct flights to U.S. cities. Aeroflot flies to New York City, Washington, DC, and Los Angeles; Delta flies to New York; Transaero to New York and Miami, and Singapore Airlines flies to Houston. Many more international airlines transport Russian travelers to the U.S. via hubs such as Frankfurt, Copenhagen, Amsterdam, Madrid, London, and others. Overall growth in demand for the United States as a tourism destination has also been driven by an increase in disposable income in a discrete segment of Russian society. Those travelers have generally already traveled to Europe and Asia, and the United States is now an affordable destination. On March 3, 2014, the Department initiated 2 and the ITC instituted 3 five- year (‘‘sunset’’) reviews of the AD orders on PVA from Japan, Korea, and the PRC pursuant to section 751(c) of the Tariff Act of 1930, as amended (the Act). As a result of its reviews, the Department determined that revocation of the AD orders on PVA from Japan, Korea, and the PRC would likely lead to a continuation or recurrence of dumping, and notified the ITC of the magnitude of the margins of dumping likely to prevail were the orders revoked. 4 On May 18, 2015, the ITC published its determinations, pursuant to sections 751(c) and 752(a) of the Act, that revocation of the AD orders on PVA from Japan and the PRC would likely lead to a continuation or recurrence of material injury to an industry in the United States within a reasonably foreseeable time, but that revocation of the AD order on PVA from Korea would not be likely to lead to the continuation or recurrence of material injury within a reasonably foreseeable time.5 Scope of the Orders The merchandise covered by these orders is PVA. This product consists of all PVA hydrolyzed in excess of 80 percent, whether or not mixed or diluted with commercial levels of defoamer or boric acid, except as noted below. The following products are specifically excluded from the scope of these orders: (1) PVA in fiber form. (2) PVA with hydrolysis less than 83 mole percent and certified not for use in the production of textiles. (3) PVA with hydrolysis greater than 85 percent and viscosity greater than or equal to 90 cps. (4) PVA with a hydrolysis greater than 85 percent, viscosity greater than or equal to 80 cps but less than 90 cps, certified for use in an ink jet application. (5) PVA for use in the manufacture of an excipient or as an excipient in the manufacture of film coating systems which are components of a drug or dietary supplement, and accompanied by an end-use certification. (6) PVA covalently bonded with cationic monomer uniformly present on all polymer chains in a concentration equal to or greater than one mole percent. Continuation of the AD Orders on PVA From Japan and the PRC As a result of the determinations by the Department and the ITC that revocation of the AD orders on PVA from Japan and the PRC would likely lead to a continuation or recurrence of dumping, and of material injury to an industry in the United States, pursuant to section 751(d)(2) of the Act, the Department hereby orders the continuation of the AD orders on PVA from Japan and the PRC. U.S. Customs and Border Protection (CBP) will continue to collect AD cash deposits at the rates in effect at the time of entry for all imports of subject merchandise. The effective date of the continuation of the orders will be the date of publication in the Federal Register of this notice of continuation. Pursuant to section 751(c)(2) of the Act, the Department intends to initiate the next five-year review of these orders not later than 30 days prior to the fifth anniversary of the effective date of continuation. Revocation of the AD Order on PVA From Korea As a result of the determination by the ITC that revocation of the AD order on PVA from Korea would not be likely to lead to continuation or recurrence of material injury to an industry in the United States, pursuant to section 751(d)(2) of the Act, the Department is revoking the AD order on PVA from Korea. Pursuant to section 751(d)(2) of the Act and 19 CFR 351.222(i)(2)(i), the effective date of revocation is April 13, 2014 (i.e., the fifth anniversary of the date of publication in the Federal Register of the previous continuation of these orders).6 Cash Deposits and Assessment of Duties for PVA From Korea The Department will notify CBP, 15 days after publication of this notice, to terminate the suspension of liquidation and to discontinue the collection of cash deposits on entries of the subject merchandise from Korea, entered or withdrawn from warehouse, on or after April 13, 2014. The Department will further instruct CBP to refund with interest all cash deposits on entries made on or after April 13, 2014. Entries of subject merchandise prior to the effective date of revocation will continue to be subject to suspension of liquidation and AD deposit requirements and assessments. SUPPLEMENTARY INFORMATION : Background On July 22, 2008, the Department published antidumping duty (AD) and countervailing duty (CVD) orders on CWP imports from China. 1 The Government of China (GOC) challenged the CWP orders and three other sets of simultaneously imposed AD and CVD orders before the WTO’s Dispute Settlement Body. The WTO Appellate Body in March 2011 found that the United States had acted inconsistently with its international obligations in several respects, including the potential imposition of overlapping remedies, or so-called ‘‘double remedies.’’ 2 The U.S. Trade Representative announced the United States’ intention to comply with the WTO’s rulings and recommendations, and the Department initiated a section 129 proceeding. 3 On July 31, 2012, the Department issued its final determination memorandum in the section 129 CVD proceeding on, inter alia, the double remedies issue. 4 Based on its analysis of broad manufacturing-level information, the Department found that an adjustment was warranted to the antidumping duty on U.S. CWP imports from China to account for remedies that overlap those imposed by the CVD order.5 On August 30, 2012, acting at the direction of the U.S. Trade Representative pursuant to section 129, the Department published a notice implementing that final determination.6 Plaintiff Wheatland Tube Company, Consolidated Plaintiff-Intervenor United States Steel Corporation, and Consolidated Plaintiff-Intervenors Allied Tube and Conduit and TMK IPSCO (collectively, the Domestic Interested Parties), challenged the Department’s determination at the CIT. On November 26, 2014, the Court remanded the section 129 Final Determination to the Department for further consideration of the finding that certain countervailable subsidies reduced the average price of U.S. CWP imports, such that the reduction warranted an adjustment to the companion AD rates under section 777A(f) of the Act.7 Following the CIT’s issuance of the Remand Order, the Department released a questionnaire to the original respondents in the CWP CVD investigation to obtain information necessary for its analysis under the Remand Order.8 The Department also issued copies of the questionnaire to the GOC and its counsel in the section 129 proceeding.9 Neither mandatory respondent nor the GOC, however, filed a response to this questionnaire or comments. On July 2, 2003, the Department of Commerce issued an antidumping duty order on imports of polyvinyl alcohol from Japan (68 FR 39518). Following first five-year reviews by Commerce and the Commission, effective April 13, 2009, Commerce issued a continuation of the antidumping duty orders on imports of polyvinyl alcohol from China, Japan, and Korea (74 FR 16834). The Commission is now conducting second reviews to determine whether revocation of the orders would be likely to lead to continuation or recurrence of material injury to the domestic industry within a reasonably foreseeable time. It will assess the adequacy of interested party responses to this notice of institution to determine whether to conduct full or expedited reviews.
