=== USITC Determination - Final === 537Federal Register / Vol. 91, No. 4 / Wednesday, January 7, 2026 / Notices 1 The record is defined in § 207.2(f) of the Commission’s Rules of Practice and Procedure (19 CFR 207.2(f)). 2 90 FR 46787, 90 FR 46791, 90 FR 46800, and 90 FR 46805 (September 30, 2025). 3 The Commission also finds that imports subject to Commerce’s affirmative critical circumstances determination are likely to undermine seriously the remedial effect of the countervailing duty orders on TMFPs from Vietnam. Commissioner Johanson dissented with respect to the critical circumstances determination. 4 Due to the lapse in appropriations and ensuing cessation of Commission operations, the Commission tolled its schedule for this proceeding. The schedule was revised in a subsequent notice published in the Federal Register on November 21, 2025 (90 FR 52697). Museum of Art, Rhode Island School of Design (‘‘RISD Museum’’, ‘‘RISD’’), intends to repatriate certain cultural items that meet the definition of objects of cultural patrimony and that have a cultural affiliation with the Indian Tribes or Native Hawaiian organizations in this notice. DATES : Repatriation of the cultural items in this notice may occur on or after February 6, 2026. ADDRESSES : Send additional written requests for repatriation of the cultural items in this notice to Joe Leduc or Marı´a Fernanda Mancera, Museum of Art, Rhode Island School of Design, 20 North Main Street, Providence, RI 02903, email jleduc@risd.edu or mmancera@risd.edu. SUPPLEMENTARY INFORMATION : This notice is published as part of the National Park Service’s administrative responsibilities under NAGPRA. The determinations in this notice are the sole responsibility of the RISD Museum, and additional information on the determinations in this notice, including the results of consultation, can be found in the summary or related records. The National Park Service is not responsible for the determinations in this notice. Abstract of Information Available A total of two cultural items have been requested for repatriation. The objects of cultural patrimony are a cooking basket and a necked jar. The first one features abstract banded designs, while the second exhibits a diamond rattlesnake pattern. The cooking basket entered the RISD Museum’s collection as a gift from Mrs. Gustav Radeke from Providence, RI, in 1920, and was identified as being of Yokut origin. The necked jar was a gift from Mrs. Kenneth F. Wood of Barrington, RI, and was entered into the collection in 1943. It was catalogued as Tulare. There is no known presence of potentially hazardous substances in either of the objects of cultural patrimony. Determinations The RISD Museum has determined that: • The two objects of cultural patrimony described in this notice have ongoing historical, traditional, or cultural importance central to the Native American group, including any constituent sub-group (such as a band, clan, lineage, ceremonial society, or other subdivision), according to the Native American traditional knowledge of an Indian Tribe or Native Hawaiian organization. • There is a connection between the cultural items described in this notice and the Tejon Indian Tribe. Requests for Repatriation Additional written requests for repatriation of the cultural items in this notice must be sent to the authorized representative identified in this notice under ADDRESSES. Requests for repatriation may be submitted by any lineal descendant, Indian Tribe, or Native Hawaiian organization not identified in this notice who shows, by a preponderance of the evidence, that the requestor is a lineal descendant or a culturally affiliated Indian Tribe or Native Hawaiian organization. Repatriation of the cultural items in this notice to a requestor may occur on or after February 6, 2026. If competing requests for repatriation are received, the RISD Museum must determine the most appropriate requestor prior to repatriation. Requests for joint repatriation of the cultural items are considered a single request and not competing requests. The RISD Museum is responsible for sending a copy of this notice to the Indian Tribes and Native Hawaiian organizations identified in this notice and to any other consulting parties. Authority: Native American Graves Protection and Repatriation Act, 25 U.S.C. 3004 and the implementing regulations, 43 CFR 10.9. Dated: December 18, 2025. (‘‘Genera’’), Vonore, Tennessee; Tellus Products, LLC (‘‘Tellus’’), Belle Glade, Florida; and the United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union, AFL–CIO (‘‘USW’’). The final phase of the investigations was scheduled by the Commission following notification of preliminary determinations by Commerce that imports of TMFPs from China and Vietnam were subsidized within the meaning of section 703(b) of the Act (19 U.S.C. 1671b(b)) and sold at LTFV within the meaning of 733(b) of the Act (19 U.S.C. 1673b(b)). Notice of the scheduling of the final phase of the Commission’s investigations and of a public hearing to be held in connection therewith was given by posting copies of the notice in the Office of the Secretary, U.S. International Trade Commission, Washington, DC, and by publishing the notice in the Federal Register on May 12, 2025 (90 FR 23066, May 30, 2025, as revised in 90 FR 25642, June 17, 2025).4 The Commission conducted its hearing on September 30, 2025. All persons who requested the opportunity were permitted to participate. The Commission made these determinations pursuant to §§ 705(b) and 735(b) of the Act (19 U.S.C. 1671d(b) and 19 U.S.C. 1673d(b)). It completed and filed its determinations in these investigations on January 5, 2025. The public record for these investigations may be viewed on the Commission’s electronic docket (EDIS) at https://edis.usitc.gov. SUPPLEMENTARY INFORMATION : Scope.—For purposes of these investigations, Commerce has defined the subject merchandise as thermoformed molded fiber products regardless of shape, form, function, fiber source, or finish. Thermoformed molded fiber products are formed with cellulose fibers, thermoformed using one or more heated molds, and cured in the mold. Thermoformed molded fiber products include, but are not limited to, plates, bowls, clamshells, trays, lids, food or foodservice contact packaging, and consumer or other product packaging. Thermoformed molded fiber products are relatively dense, with a typical fiber density above 0.5 grams per cubic centimeter, and are generally characterized by relatively smooth surfaces. They may be derived from any virgin or recycled cellulose fiber source (including, but not limited to, those sourced from wood, woody crops, agricultural crops/byproducts/residue, and agricultural/industrial/other waste). They may have any weight, shape, dimensionality, design, or size, and may be bleached, unbleached, dyed, colored, or printed. They may include ingredients, additives, or chemistries to enhance functionality including, but not limited to, anti-microbial, anti-fungal, antibacterial, heat/flame resistant, hydrophobic, oleophobic, absorbent, or adsorbent. Thermoformed molded fiber products may also be subject to other processing or treatments, including, but not limited to, hot or after pressing, die- cutting, punching, trimming, padding, perforating, printing, labeling, dying, coloring, coating, laminating, embossing, debossing, repacking, or denesting. Thermoformed molded fiber products subject to this investigation may also have additional design features, including, but not limited to, tab closures, venting, channeling, or stiffening. Thermoformed molded fiber products remain covered by the scope of this investigation if the subject product is encased by exterior packaging. They also remain covered by the scope of this investigation whether imported alone, or in any combination of subject and non-subject merchandise (e.g., a lid or cover of any type packaged with a molded fiber bowl, addition of any items to make the thermoformed molded fiber packaging suitable for end- use such as absorbent pads). When thermoformed molded fiber products are imported in combination with non- subject merchandise, only the thermoformed molded fiber products are subject merchandise. Also excluded from the scope of this investigation are products covered by the scope of the antidumping and countervailing duty orders on paper plates from People’s Republic of China, the Kingdom of Thailand, and the Socialist Republic of Vietnam. Excluded from the scope of this investigation are thermoformed molded fiber products imported as packaging material that enclose and/or surround non-subject merchandise prepackaged for final sale upon importation into the United States (e.g., molded fiber packaging surrounding a cellular phone). Abstract: Reclamation is responsible for recreation development at all of its reservoirs. Presently, there are more than 240 designated recreation areas on our lands within the 17 Western States hosting approximately 40 million visitors annually. As a result, we must be able to respond to emerging trends, changes in the demographic profile of users, changing values, needs, wants, and desires, and conflicts between user groups. Statistically valid and up-to-date data derived from the user is essential to developing and providing recreation programs relevant to today’s visitor. Reclamation is requesting re-approval for the collection of data from recreational users on Reclamation lands and waterbodies. To meet our needs for the collection of visitor use data, we will be requesting OMB to authorize a two-part request: survey questions for our regional offices to choose from, and a survey form template. This will allow for a custom designed survey instrument to fit a specific activity or recreation site. The custom designed survey would be created by extracting questions from the approved list of survey questions that are applicable to the recreation area and issue being evaluated. Only questions included in the pre-approved list of survey questions will be used. Revisions to this collection will be made to adjust respondent demographic questions to conform with Executive Order 14168, ‘‘Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government’’ (January 20, 2025) and OMB’s ‘‘2024 Statistical Policy Directive No. 15: Federal Race and Ethnicity Data Standards.’’ Title of Collection: Recreation Survey Questions. OMB Control Number: 1006–0028. Form Number: 7–2675, Recreation Survey Questions. Type of Review: Revision of a currently approved collection. Respondents/Affected Public: Respondents to the surveys will be members of the public engaged in recreational activities on Reclamation lands and waterbodies. Visitors will primarily consist of local residents, people from large metropolitan areas in the vicinity of the lake/reservoir, and people from out of state. Total Estimated Number of Annual Respondents: 696. Total Estimated Number of Annual Responses: 696. Estimated Completion Time per Response: 15 minutes per survey (an average of 20 questions will be used on each survey; each question will take approximately 45 seconds to complete on average). Total Estimated Number of Annual Burden Hours: 140. Respondent’s Obligation: Voluntary. Frequency of Collection: Twice annually. Total Estimated Annual Nonhour Burden cost: None. Reclamation estimates that there will be a total of 140 out of 696 contacts that choose not to respond to the survey. These non-respondents account for 1 burden hour per year. An agency may not conduct or sponsor and a person is not required to respond to a collection of information unless it displays a currently valid OMB control number. The authority for this action is the Paperwork Reduction Act of 1995 (44 U.S.C. 3501 et seq). Stephanie McPhee, Acting Information Collection Clearance Officer, Bureau of Reclamation. Active order issued from this investigation
Investigation 701-TA-739 is a U.S. International Trade Commission antidumping (AD) proceeding on Thermoformed Molded Fiber Products from China and Vietnam; Inv. No. 701-TA-739-740 and 731-TA-1716-1717 (Final) from Vietnam, China. The ITC determines whether U.S. industry is materially injured (or threatened) by imports under investigation; Commerce determines whether dumping or subsidization is occurring. Both findings are required for an AD/CVD order to be issued.
701-TA-739 is in the final phase, with status completed. Final phase — the ITC's final determination on injury, after Commerce issues its final dumping/subsidy determination. An affirmative final determination from both agencies triggers issuance of an AD/CVD order.
Yes — investigation 701-TA-739 resulted in AD/CVD case A-552-845. The linked order page on this catalog has the active deposit rate, scope text, and Federal Register citation.
