SUPPLEMENTARY INFORMATION : Background.—On October 21, 1977, the Department of the Treasury issued an antidumping finding on imports of pressure sensitive plastic tape from Italy (42 FR 56110). Following first five-year reviews by Commerce and the Commission, effective February 17, 1999, Commerce issued a continuation of the antidumping duty finding on imports of pressure sensitive plastic tape from Italy (64 FR 51515, September 23, 1999). Following second five-year reviews by Commerce and the Commission, effective June 25, 2004, Commerce issued a second continuation of the antidumping duty finding on imports of pressure sensitive plastic tape from Italy (69 FR 35584). Following third five-year reviews by Commerce and the Commission, effective April 5, 2010, Commerce issued a continuation of the antidumping duty finding on imports of pressure sensitive plastic tape from Italy (75 FR 17124). The Commission is now conducting a fourth review to determine whether revocation of the finding would be likely to lead to continuation or recurrence of material injury to the domestic industry within a reasonably foreseeable time. It will assess the adequacy of interested party responses to this notice of institution to determine whether to conduct a full review or an expedited review. The Commission’s determination in any expedited review will be based on the facts available, which may include information provided in response to this notice. Definitions.—The following definitions apply to this review: (1) Subject Merchandise is the class or kind of merchandise that is within the scope of the five-year review, as defined by the Department of Commerce. (2) The Subject Country in this review is Italy. (3) The Domestic Like Product is the domestically produced product or products which are like, or in the absence of like, most similar in characteristics and uses with, the Subject Merchandise. The Commission did not make a like product determination per se in its original determination; however, the Commission considered the U.S. industry to consist of all domestic facilities that were devoted to the production of pressure sensitive plastic tape. In its expedited first and second five-year review determinations and in its full third five-year review determinations, the Commission found that the appropriate definition of the Domestic Like Product was the same as Commerce’s scope: Pressure sensitive plastic tape measuring over 13⁄8 inches in width and not exceeding 4 mils in thickness. (4) The Domestic Industry is the U.S. producers as a whole of the Domestic Like Product, or those producers whose collective output of the Domestic Like Product constitutes a major proportion of the total domestic production of the product. In its original determination, its expedited first and second five-year review determinations, and its full third five-year review determinations, the Commission defined the Domestic Industry as all producers of pressure sensitive plastic tape. (5) An Importer is any person or firm engaged, either directly or through a parent company or subsidiary, in importing the Subject Merchandise into the United States from a foreign manufacturer or through its selling agent. Changes Since the Preliminary Results Based on the comments received from Jindal, SRF, and domestic interested parties Polyplex USA LLC and Flex USA, we made the following changes to our rate calculations for Jindal and SRF: We adjusted the cash deposit rates for Jindal and SRF, as necessary, to exclude the foreign currency denominated pre- and post-export financing benefits. Further, we revised our allocation calculations and adjusted the numerator in our subsidy rate calulations for Jindal with respect to the Status Holder Incentive Scheme (SHIS). Final Results of Administrative Review In accordance with section 777A(e)(1) of the Tariff Act of 1930, as amended (the Act) and 19 CFR 351.221(b)(5), we calculated individual ad valorem subsidy rates for Jindal and SRF, for the POR for this administrative review. The Department will instruct CBP to liquidate shipments of subject merchandise produced and/or exported by Jindal and SRF, respectively, entered or withdrawn from warehouse, for consumption from January 1, 2012, through December 31, 2012, at 7.66 percent ad valorem and at 2.03 percent ad valorem, respectively, of the entered value. The Department intends also to instruct CBP to collect cash deposits of estimated countervailing duties at the rate of 7.66 percent ad valorem for Jindal and of 2.03 4 percent ad valorem for SRF of the entered value on shipments of the subject merchandise produced and exported by SRF, entered, or withdrawn from warehouse, for consumption on or after the date of publication of the final results of this review. We intend to instruct CBP to continue to collect cash deposits for non-reviewed companies at the applicable company-specific countervailing duty rate for the most recent period or the all-others rate established in the investigation. These rules, including electronic filing requirements via Enforcement and Compliance’s Antidumping and Countervailing Duty Centralized Electronic Service System (‘‘ACCESS’’), can be found at 19 CFR 351.303. 1 Revised Factual Information Requirements This notice serves as a reminder that any party submitting factual information in an AD/CVD proceeding must certify to the accuracy and completeness of that information. 2 Parties are hereby reminded that revised certification requirements are in effect for company/ government officials as well as their representatives in all AD/CVD investigations or proceedings initiated on or after August 16, 2013. 3 The formats for the revised certifications are provided at the end of the Final Rule. The Department intends to reject factual submissions if the submitting party does not comply with the revised certification requirements. On April 10, 2013, the Department published Definition of Factual Information and Time Limits for Submission of Factual Information: Final Rule, 78 FR 21246 (April 10, 2013), which modified two regulations related to antidumping and countervailing duty proceedings: The definition of factual information (19 CFR 351.102(b)(21)), and the time limits for the submission of factual information (19 CFR 351.301). The final rule identifies five categories of factual information in 19 CFR 351.102(b)(21), which are summarized as follows: (i) Evidence submitted in response to questionnaires; (ii) evidence submitted in support of allegations; (iii) publicly available information to value factors under 19 CFR 351.408(c) or to measure the adequacy of remuneration under 19 CFR 351.511(a)(2); (iv) evidence placed on the record by the Department; and (v) evidence other than factual information described in (i)–(iv). The final rule requires any party, when submitting factual information, to specify under which subsection of 19 CFR 351.102(b)(21) the information is being submitted and, if the information is submitted to rebut, clarify, or correct factual information already on the record, to provide an explanation identifying the information already on the record that the factual information seeks to rebut, clarify, or correct. The final rule also modified 19 CFR 351.301 so that, rather than providing general time limits, there are specific time limits based on the type of factual information being submitted. These modifications are effective for all segments initiated on or after May 10, 2013. To the extent that other regulations govern the submission of factual information in a segment (such as 19 CFR 351.218), these time limits will continue to be applied. Revised Extension of Time Limits Regulation On September 20, 2013, the Department modified its regulation at 19 CFR 351.302(c) concerning the extension of time limits for submissions in antidumping and countervailing duty proceedings: Extension of Time Limits, 78 FR 57790 (September 20, 2013). In general, an extension request will be considered untimely if it is filed after the time limit established under part 351 expires. For submissions which are due from multiple parties simultaneously, an extension request will be considered untimely if it is filed after 10:00 a.m. on the due date. Under certain circumstances, the Department may elect to specify a different time limit by which extension requests will be considered untimely for submissions which are due from multiple parties simultaneously. In such a case, the Department will inform parties in the letter or memorandum setting forth the deadline (including a specified time) by which extension requests must be filed to be considered timely. This modification also requires that an extension request must be made in a separate, stand-alone submission, and clarifies the circumstances under which the Department will grant untimely- filed requests for the extension of time limits. These modifications are effective for all segments initiated on or after October 21, 2013. Information Required From Interested Parties Domestic interested parties, as defined in section 771(9)(C), (D), (E), (F), and (G) of the Act and 19 CFR 351.102(b), wishing to participate in a Sunset Review must respond not later than 15 days after the date of publication in the Federal Register of this notice of initiation by filing a notice of intent to participate. The required contents of the notice of intent to participate are set forth at 19 CFR 351.218(d)(1)(ii). SUPPLEMENTARY INFORMATION : Background On March 2, 2015, the Department initiated 1 and the ITC instituted 2 five- year (‘‘sunset’’) reviews of the antidumping duty finding on PSP tape from Italy, pursuant to section 751(c) of the Tariff Act of 1930, as amended (the Act). As a result of its review, the Department determined that revocation of the antidumping duty finding on PSP tape from Italy would likely lead to a continuation or recurrence of dumping and notified the ITC of the magnitude of the margins of dumping likely to prevail were the finding revoked. 3 On April 8, 2016, the ITC published its determination, pursuant to sections 751(c) and 752(a) of the Act, that revocation of the antidumping duty finding order on PSP tape from Italy would likely lead to a continuation or recurrence of material injury to an industry in the United States within a reasonably foreseeable time.4 Scope of the Finding The products covered by the finding are shipments of PSP tape measuring over one and three-eighths inches in width and not exceeding four mils 5 in thickness. The above described PSP tape is classified under Harmonized Tariff Schedule of the United States (HTSUS) subheadings 3919.90.10.20 and 3919.90.50. The HTSUS subheadings are provided for convenience and for customs purposes. The written description remains dispositive. Continuation of the Finding As a result of the determinations by the Department and the ITC that revocation of the antidumping duty finding on PSP tape from Italy would likely lead to a continuation or recurrence of dumping, and of material injury to an industry in the United States, pursuant to section 751(d)(2) of the Act, the Department hereby orders the continuation of the antidumping duty finding on PSP tape from Italy. U.S. Customs and Border Protection will continue to collect antidumping duty cash deposits at the rates in effect at the time of entry for all imports of subject merchandise. The effective date of the continuation of the finding will be the date of publication in the Federal Register of this notice of continuation. Pursuant to section 751(c)(2) of the Act, the Department intends to initiate the next five-year review of the finding not later than 30 days prior to the fifth anniversary of the effective date of continuation. Rescission of Review Pursuant to 19 CFR 351.213(d)(1), the Department will rescind an administrative review, in whole or in part, if the party that requested the review withdraws its request within 90 days of the publication of the notice of initiation of the requested review. In this case, Petitioners timely withdrew their request of all three companies by the 90-day deadline, and no other party requested an administrative review of the antidumping duty order. Abstract The Bureau of Reclamation (Reclamation) is responsible for approximately 6.5 million acres of land which directly support Reclamation’s Federal water projects in the 17 Western States. Under Title 43 CFR part 429, individuals or entities wanting to use Reclamation’s lands, facilities, or waterbodies must apply using Form 7– 2540. Examples of such uses are: —Agricultural uses such as grazing and farming; —commercial or organized recreation and sporting activities; —other commercial activities such as ‘‘guiding and outfitting’’ and ‘‘filming and photography;’’ and —resource exploration and extraction, including sand and gravel removal and timber harvesting. Reclamation reviews applications to determine whether granting individual use authorizations is compatible with Reclamation’s present or future uses of the lands, facilities, or waterbodies. When we find a proposed use compatible, we advise the applicant of the estimated administrative costs and estimated application processing time. In addition to the administrative costs, we require the applicant to pay a use fee based on a valuation or by competitive bidding. If the application is for construction of a bridge, building, or other significant construction project, Reclamation may require that all plans and specifications be signed and sealed by a licensed professional engineer. The required 60-day public comment period for the Bureau of Reclamation Use Authorization Application was initiated by a notice published in the Federal Register on November 14, 2014 (79 FR 68297). No public comments were received. II. Changes to the Bureau of Reclamation Use Authorization Application Form and Its Instructions The only change made to the form was to improve the readability and information-gathering, and to update the Web site links.
