1. On 11/08/2019, the U.S. Court of International Trade issued a final decision in POSCO v. United States, Consol. Court No. 17'00137, Slip Op. 18-169. As a result of this decision, on 11/22/2019, Commerce published in the Federal Register 'Certain Carbon and Alloy Steel Cut-To Length Plate From the Republic of Korea: Notice of Court Decision Not in Harmony With Final Countervailing Duty Determination, and Notice of Amended Final Countervailing Duty Determination' (Amended Final Determination), 84 FR 64459, which amends the cash deposit rate for certain firms. 2. Accordingly, effective 11/18/2019 (the effective date stated in the Amended Final Determination), for shipments of certain carbon and alloy steel cut-to-length plate from the Republic of Korea entered, or withdrawn from warehouse, for consumption on or after 11/18/2018, U.S. Customs and Border Protection (CBP) shall require, for such entries, a cash deposit equal to the margins listed below: Producer and/or Exporter: POSCO Case number: C-580-888-001 Amended rate: 3.72% Producer and/or Exporter: All-Others Case number: C-580-888-000 Amended rate: 3.72% 3. Instructions for granting a request for a refund on any overcollection on entries made on or after 11/18/2019 through the date of this message will be issued in a separate message. 4. These cash deposit requirements will remain in effect until further notice. 5. Do not liquidate any entries of this merchandise until specific liquidation instructions are issued. 6.
