Amended cash deposit instructions for certain cold-rolled steel flat products from the Republic of Korea (C-580-882)

1. On 09/10/2018, the U.S. Court of International Trade issued a final decision in POSCO et al., and AK Steel Corporation, et al., v. United States and Steel Dynamic Inc., et al., Consol. Court No. 16–00225, slip op. 18–18. As a result of this decision, on 09/24/2018, Commerce published in the Federal Register “Certain Cold-Rolled Steel Flat Products From the Republic of Korea: Notice of Court Decision Not in Harmony With Amended Final Determination of the Countervailing Duty Investigation” (Second Amended Final Determination) (83 FR 48277), which amends the cash deposit rate for certain firms. 2. Accordingly, effective 09/20/2018 (the effective date stated in the Second Amended Final Determination), for shipments of certain cold-rolled steel flat products from the Republic of Korea entered, or withdrawn from warehouse, for consumption on or after 09/20/2018, CBP shall require, for such entries, a cash deposit equal to the margins listed below: Producer and/or Exporter: POSCO Case number: C-580-882-002 Amended rate: 42.61% 3. Instructions for granting a request for a refund on any overcollection on entries made on or after 09/20/2018 through the date of this message will be issued in a separate message. 4.
