1. On 09/17/2018, the U.S. Court of International Trade (CIT) sustained the Final Redetermination issued by Commerce pursuant to CP Kelco US, Inc. v. United States (CIT No. 13-00288). As a result, Commerce published in the Federal Register (83 FR 52205) on 10/16/2018, with an effective date of 09/27/2018, the Notice of Court Decision Not in Harmony with Amended Final Determination in Less Than Fair Value Investigation; Notice of Amended Final Determination Pursuant to Court Decision; Notice of Revocation of Antidumping Duty Order in Part; and Discontinuation of Fourth and Fifth Antidumping Duty Administrative Reviews in Part. 2. As a result of the CIT's final decision, xanthan gum from the People's Republic of China (China), produced and exported by Neimenggu Fufeng Biotechnologies Co., Ltd. (aka Inner Mongolia Fufeng Biotechnologies Co., Ltd.) and Shandong Fufeng Fermentation, Co., Ltd. (Fufeng) is being excluded from the antidumping duty order on xanthan gum from China. Accordingly, CBP is directed to suspend or continue to suspend liquidation of the entries of xanthan gum from the People's Republic of China, produced and exported by Fufeng entered, or withdrawn from warehouse, for consumption on or after 09/27/2018 at a zero cash deposit rate. 3. Because the revised cash deposit rate is to be applied to entries made on or after 09/27/2018, Commerce will issue instructions for granting a refund on any over collection in a separate message. 4. These cash deposit requirements will remain in effect until further notice. 5. Do not liquidate any entries of the merchandise covered by paragraph 2 above until specific liquidation instructions are issued. 6. Unless instructed otherwise, for all other shipments of xanthan gum from China not covered by paragraph 2 above, you shall continue to collect cash deposits of estimated antidumping duties for the merchandise at the current rates. 7.
