Correction of message 8233306

Plain-English explanation

CSMS 8243305 is a U.S. Customs and Border Protection (CBP) Cargo Systems Messaging Service bulletin (trade policy), published on August 31, 2018. It carries the official CBP guidance brokers and importers must follow for the topic — "Correction of message 8233306". It links to 1 AD/CVD case in Tandom's catalog. CSMS messages are the operational layer between Commerce determinations and at-the-border collections: when Commerce publishes a new rate, scope ruling, or instruction, CBP turns it into a CSMS that ACE/ACS systems and brokers act on.

1. This is a correction to message 8233306, dated 08/21/2018, to correct paragraph 5 of that message. 2. Paragraph 5 of message 8233306 contains incorrect information regarding the cash deposit rates, which were erroneously listed as the rates adjusted for certain subsidies determined in the companion countervailing duty investigation. We have corrected this in the amended final determination (83 FR 44570, 08/31/2018). Below is the fully corrected message. 3. On 07/17/2018, Commerce published in the Federal Register (83 FR 33205) its final determination of sales at less than fair value in the antidumping duty investigation of cast iron soil pipe fittings from the People's Republic of China (China). 4. The merchandise covered by this investigation is cast iron soil pipe fittings, finished and unfinished, regardless of industry or proprietary specifications, and regardless of size. Cast iron soil pipe fittings are nonmalleable iron castings of various designs and sizes, including, but not limited to, bends, tees, wyes, traps, drains, and other common or special fittings, with or without side inlets. Cast iron soil pipe fittings are classified into two major types – hubless and hub and spigot. Hubless cast iron soil pipe fittings are manufactured without a hub, generally in compliance with Cast Iron Soil Pipe Institute (CISPI) specification 301 and/or American Society for Testing and Materials (ASTM) specification A888. Hub and spigot pipe fittings have hubs into which the spigot (plain end) of the pipe or fitting is inserted. Cast iron soil pipe fittings are generally distinguished from other types of nonmalleable cast iron fittings by the manner in which they are connected to cast iron soil pipe and other fittings. The subject imports are normally classified in subheading 7307.11.0045 of the Harmonized Tariff Schedule of the United States (HTSUS): Cast fittings of nonmalleable cast iron for cast iron soil pipe. They may also be entered under HTSUS 7324.29.0000 and 7307.92.3010. The HTSUS subheadings and specifications are provided for convenience and customs purposes only; the written description of the scope of this investigation is dispositive. 5. This proceeding has been assigned case number A-570-062. 6. Because Commerce determined that critical circumstances exist for imports of cast iron soil pipe fittings for the China-wide entity, CBP shall continue to suspend liquidation of such shipments of cast iron soil pipe fittings from that are entered, or withdrawn from warehouse, for consumption on or after 11/22/2017, which is 90 days before the date of publication of the preliminary determination in the Federal Register (83 FR 7145, 02/20/2018) through 07/16/2018 (the date prior to publication of the final determination) at the rates established in the preliminary determination, see message 8057305, dated 02/26/2018. 7. Effective 07/17/2018, for entries of cast iron soil pipe fittings from China, from the exporter/producer combinations listed below, CBP shall require a cash deposit equal to the following dumping margins. Exporter: China-Wide Entity Case number: A-570-062-000 Cash deposit rate: 360.39 % Exporter: Sibo International Limited Producer: Qinshui Shunshida Casting Co., Ltd. Case number: A-570-062-000 Cash deposit rate: 360.39 % Note to CBP: In the final determination, Commerce determined that Sibo International Limited is no longer eligible for a separate rate and is part of the China-Wide Entity. Accordingly, Commerce has deactivated the following exporter/producer chain rate case number: A-570-062-001. Effective 07/17/2018 (the date of publication of the final determination) entries of subject merchandise from this exporter should be entered under A-570-062-000. In the final determination, Commerce found that critical circumstances do not exist with respect to imports from certain producers and/or exporters for whom Commerce found critical circumstances do exist in the preliminary determination. Accordingly, Commerce will issue separate liquidation instructions for shipments from those producers and/or exporters entered prior to the publication of the preliminary determination. 9. For all other entries of cast iron soil pipe fittings from China, the following cash deposit instructions apply: A. For all China exporters of cast iron soil pipe fittings from China which have not received their own rate, the cash deposit will be the China-wide rate. B. For all non-China exporters of cast iron soil pipe fittings from China which have not received their own rate, the cash deposit rate will be the rate applicable to the exporter/producer combinations that supplied that non-China exporter. 10.
