1. On 08/16/2018, Commerce published in the Federal Register its antidumping duty order on Low Melt Polyester Staple Fiber (Low Melt PSF) from the Republic of Korea (83 FR 40752). 2. The merchandise covered by this order is synthetic staple fibers, not carded or combed, specifically bi-component polyester fibers having a polyester fiber component that melts at a lower temperature than the other polyester fiber component (low melt PSF). The scope includes bi-component polyester staple fibers of any denier or cut length. The subject merchandise may be coated, usually with a finish or dye, or not coated. Low melt PSF is classifiable under the Harmonized Tariff Schedule of the United States (HTSUS) subheading 5503.20.0015. Although the HTSUS subheading is provided for convenience and customs purposes, the written description of the scope of the merchandise of this proceeding is dispositive. 3. For imports of Low Melt PSF from the Republic of Korea, CBP shall continue to suspend liquidation of entries of subject merchandise entered, or withdrawn from warehouse, for consumption on or after 08/09/2018 (date of publication of the International Trade Commission final determination in the Federal Register). Effective 08/09/2018, CBP shall require a cash deposit equal to the percentages identified below. Producer and/or Exporter: All-Others Case Number: A-580-895-000 Cash Deposit Rate: 16.27 percent Producer and/or Exporter: Toray Chemical Korea Inc. Case Number: A-580-895-002 Cash Deposit Rate: 16.27 percent 4. Commerce found that no final margin exists with respect to imports of Low Melt PSF from Korea produced and exported by Huvis Corporation. Therefore, the following producer/exporter combination is excluded from this order: Exporter: Huvis Corporation Producer: Huvis Corporation Case number: A-580-895-001 5. The U.S. International Trade Commission (ITC) determined that critical circumstances do not exist with respect to subject imports from the Republic of Korea. As a result of the ITC's negative determination of critical circumstances, Commerce will direct CBP in separate instructions to refund all cash deposits collected on entries of Low Melt PSF from the Republic of Korea which were entered, or withdrawn from warehouse, for consumption on or after 11/4/2017 and before 2/2/2018. The interest provisions of section 778 of the Tariff Act of 1930, as amended, do not apply. 6.
