Refund of antidumping duty cash deposit for ripe olives from Spain pursuant to the antidumping duty order for the period 07/31/2018 through 08/09/2018 (A-470-817)

1. On 08/01/2018 (83 FR 37465), Commerce published in the Federal Register its antidumping duty order in the antidumping duty investigation of ripe olives from Spain. See message 8214301, dated 08/02/2018. On 08/10/2018 (83 FR 39691), Commerce published in the Federal Register its correction notice to antidumping duty order in the antidumping duty investigation of ripe olives from Spain. See message 8222301, dated 08/10/2018. 2. Title 19 U.S.C. 1520(a)(4) authorizes refunds prior to liquidation whenever an importer of record declares or it is ascertained that excess duties, fees, charges, or exactions have been deposited or paid. In accordance with 19 U.S.C. 1520(a)(4), CBP is authorized to grant a refund, if requested by the importer, of cash deposits for entries of ripe olives from Spain from the entity listed in paragraph 4 below which were entered, or withdrawn from warehouse, for consumption during the period 07/31/2018 (date of publication of the International Trade Commission final determination in the Federal Register) through 08/09/2018 (day before date of publication of the correction notice to antidumping duty order in the Federal Register). 3. The refund amount will be calculated by determining the difference between the amount of cash deposits paid as a result of the application of the antidumping duty order cash deposit rate and the amount due as a result of the application of the corrected antidumping duty order cash deposit rate. 4. Listed below is the cash deposit rate that was assigned to a certain firm in the antidumping duty order. See message 8214301, dated 08/02/2018. In addition, listed below is the corrected cash deposit rate assigned in the corrected antidumping duty order (see message number 8222301, dated 08/10/2018): Producer and/or Exporter: Aceitunas Guadalquivir S.L. Do not liquidate entries of ripe olives from Spain produced and/or exported by the entity listed in paragraph 4 above until specific liquidation instructions are issued. 6. The assessment of antidumping duties by CBP on shipments or entries of this merchandise is subject to the provisions of section 778 of the Tariff Act of 1930, as amended. Section 778 requires that CBP pay interest on overpayments or assess interest on underpayments of the required amounts deposited as estimated antidumping duties. The interest provisions are not applicable to cash or bonds posted as estimated antidumping duties before the date of publication of the antidumping duty order. Interest shall be calculated from the date payment of estimated antidumping duties is required through the date of liquidation. The rate at which such interest is payable is the rate in effect under section 6621 of the Internal Revenue Code of 1954 for such period. 7.
