Notice of final determination in the antidumping duty investigation of Low Melt Polyester Staple Fiber from the Republic of Korea (A-580-895)

1. On 06/22/2018, Commerce published in the Federal Register (83 FR 29094) its final affirmative determination of sales at less-than-fair-value in the antidumping duty investigation of Low Melt Polyester Staple Fiber from the Republic of Korea (A-580-895). 2. The products covered by this investigation are described in message 7205316, dated 07/24/2017. 3. This proceeding has been assigned case number A-580-895. 4. Commerce has determined that critical circumstances exist for imports of Low Melt Polyester Staple Fiber from the Republic of Korea from the producer and/or exporter listed below. CBP shall continue to suspend liquidation of such shipments that are entered, or withdrawn from warehouse, for consumption on or after 11/04/2017, which is 90 days prior to the date of publication of the preliminary determination in the Federal Register. Effective 06/22/2018, for such entries, CBP shall require a cash deposit equal to the margins for the producer and/or exporter listed below: Producer and/or Exporter: Toray Chemical Korea Inc. Case number: A-580-895-002 Cash deposit rate: 16.27% 5. Because Commerce has determined that critical circumstances do not exist for imports of Low Melt Polyester Staple Fiber from the Republic of Korea from the producer and/or exporter listed below, the retroactive suspension of liquidation ordered in message 8033303, dated 02/02/2018, is terminated. Accordingly, Commerce will direct CBP in separate instructions to terminate the suspension of liquidation for all shipments of Low Melt Polyester Staple Fiber from the Republic of Korea from the producer and/or exported listed below entered, or withdrawn from warehouse, for consumption, before 06/22/2018 and to refund any cash deposits and release any other security. The interest provisions of section 778 of the Tariff Act of 1930, as amended, do not apply. Effective 06/22/2018, for such entries, CBP shall require a cash deposit equal to the margins for the producer and/or exporter listed below: All Others Case Number: A-580-895-000 Cash Deposit Rate: 16.27% 6. Commerce found that no final margin exists with respect to Low Melt Polyester Staple Fiber from the Republic of Korea from the producer and exporter listed below. Accordingly, CBP shall not suspend liquidation for shipments of subject merchandise entered, or withdrawn from warehouse, for consumption on or after 02/02/2018, that were produced and exported by the producer and exporter listed below. If the exporter of the subject merchandise does not have its own rate but the producer has its own rate, the cash deposit will be the producer's rate. B. Where neither the exporter nor the producer currently has its own rate or the producer is unknown, use the all-others rate of 16.27 percent to establish the cash deposit. 8.
