1. On 03/27/2018, the U.S. Court of International Trade issued a final decision in Changzhou Trina Solar Energy Co., Ltd., et al. v. United States, Slip Op. 18-31, Consol. Ct. No. 16-00157. As a result of this decision, on 04/10/2018, Commerce published in the Federal Register a Notice of Court Decision Not in Harmony with Final Results and Notice of Amended Final Results (83 FR 15364), which amends the final results of the administrative review of the countervailing duty (CVD) order on crystalline silicon photovoltaic cells, whether or not assembled into modules (solar cells), from the People's Republic of China (China) for the period 01/01/2013 through 12/31/2013, as they pertain to JA Solar Technology Yangzhou Co., Ltd., Changzhou Trina Solar Energy Co., Ltd., and Wuxi Suntech Power Co., Ltd. 2. Accordingly, effective 04/06/2018 (the effective date stated in the Federal Register notice identified in paragraph 1, above) for shipments of solar cells from China entered, or withdrawn from warehouse, for consumption on or after 04/06/2018, CBP shall require, for such entries, a cash deposit equal to the countervailable subsidy rate for the exporter/producer listed below: Producer and/or Exporter: JA Solar Technology Yangzhou Co., Ltd. Case number: C-570-980-083 Cash deposit rate: 24.66% Note: Commerce calculated cash deposit rates for Changzhou Trina Solar Energy Co., Ltd. and Wuxi Suntech Power Co., Ltd. in subsequent administrative reviews. Most recently, on 07/17/2017, Commerce published the final results of administrative review of the CVD order on solar cells from China for the period 01/01/2014 through 12/31/2014 (82 FR 32678), which revised the cash deposit rates for certain firms, including Changzhou Trina Solar Energy Co., Ltd., and Wuxi Suntech Power Co., Ltd. See message 7199318, dated 07/18/2017. Commerce published an amendment to those cash deposit instructions for certain companies on 10/06/2017 (82 FR 46760). See message 7289301, dated 10/16/2017. Therefore, Commerce did not amend the cash deposit rates pursuant to the Court decision here for those firms. 3. These cash deposit requirements shall remain in effect until further notice.
