Notice of a preliminary determination in an antidumping duty investigation of fine denier polyester staple fiber from India (A-533-875)

1. On 01/05/2018, Commerce published in the Federal Register its affirmative preliminary determination of sales at less than fair value and postponement of the final determination in the antidumping duty investigation of fine denier polyester staple fiber (fine denier PSF) from India (83 FR 662). 2. The merchandise covered by this investigation is fìne denier polyester staple fiber (fine denier PSF), not carded, combed, or pre-opened, measuring less than 3.3 decitex (3 denier) in diameter. The scope covers all fine denier PSF, whether coated or uncoated. The following products are excluded from the scope: (1) PSF equal to or greater than 3.3 decitex (more than 3 denier, inclusive) currently classifiable under Harmonized Tariff Schedule of the United States (HTSUS) subheadings 5503.20.0045 and 5503.20.0065. (2) Low-melt PSF defined as a bi-component polyester fiber having a polyester fiber component that melts at a lower temperature than the other polyester fiber component, which is currently classifiable under HTSUS subheading 5503.20.0015. Fine denier PSF is classifiable under the HTSUS subheading 5503.20.0025. Although the HTSUS subheadings are provided for convenience and customs purposes, the written description of the scope of this investigation is dispositive. 3. This proceeding has been assigned case number A-533-875. 4. For imports of fine denier PSF from India, CBP shall suspend liquidation of such shipments entered, or withdrawn from warehouse, for consumption on or after 01/05/2018. Effective 01/05/2018, CBP shall require, for such entries, a cash deposit equal to the margins for the producers and/or exporters listed below: Producer and/or Exporter: Reliance Industries Limited Case number: A-533-875-001 Cash deposit rate: 0.66% Producer and/or Exporter: Bombay Dyeing & Manufacturing Company Limited Case number: A-533-875-002 Cash deposit rate: 15.66% All Others Case Number: A-533-875-000 Cash Deposit Rate: 0.00% 5. If any entries of this merchandise are exported by a firm other than the producer, then the following instructions apply: A. If the exporter of the subject merchandise does not have its own rate but the producer has its own rate, the cash deposit or bonding rate will be the producer's rate. B. Where neither the exporter nor the producer has its own rate or the producer is unknown, use the all-others rate of 0.00 percent to establish the cash deposit. 6.
