1. On 11/16/2017, Commerce published in the Federal Register (82 FR 53477) its affirmative final determination and negative determination of critical circumstances in the countervailing duty (CVD) investigation of biodiesel from Argentina (C-357-821). 2. The products covered by this investigation are described in message 7114303, dated 04/24/2017. 3. This proceeding has been assigned case number C-357-821. 4. Because Commerce now determines that critical circumstances do not exist for LDC Argentina S.A. (C-357-821-001) and for Vicentin S.A.I.C. (C-357-821-002), the retroactive suspension of liquidation ordered at the time of the preliminary determination and the preliminary critical circumstances determination (message 7241303, dated 08/29/2017), is terminated. Accordingly, Commerce will direct CBP in separate instructions to terminate the suspension of liquidation for all shipments of biodiesel from Argentina from LDC Argentina S.A. (C-357-821-001) and Vicentin S.A.I.C. (C-357-821-002), entered, or withdrawn from warehouse, for consumption, prior to 08/28/2017, and to refund any cash deposits. Interest provisions of section 778 of the Tariff Act of 1930, as amended, do not apply. 5. For imports of biodiesel from Argentina, CBP shall continue to suspend liquidation of such shipments entered, or withdrawn from warehouse, for consumption on or after 08/28/2017. Effective 11/16/2017, CBP shall require, for such entries, a cash deposit equal to the subsidy rates for the producer(s) and/or exporter(s) listed below: Producer and/or Exporter: LDC Argentina S.A. LDC Semillas S.A. Semillas del Rosario S.A. Case number: C-357-821-001 Cash deposit rate: 72.28% Producer and/or Exporter: Vicentin S.A.I.C. Oleaginosa San Lorenzo S.A.. Los Amores S.A. Case number: C-357-821-002 Cash deposit rate: 71.45% All Others Case Number: C-357-821-000 Cash Deposit Rate: 71.87% 6.
