Refund of AD cash deposits for certain passenger vehicle and light truck tires from the PRC pursuant to the second amended final determination for the period 08/06/2015- 10/04/2017 (A-570-016)

1. On 09/25/2017, the U.S. Court of International Trade issued a final decision in Cooper Tire & Rubber Company, Cooper (Kunshan) Tire Co., Ltd., and Cooper Chengshan (Shandong) Tire Co., Ltd. v. United States, Court No. 15-00251, Slip Op. 17-130. As a result of this decision, on 10/04/2017, Commerce published in the Federal Register “Certain Passenger Vehicle and Light Truck Tires from the People's Republic of China: Notice of Court Decision Not in Harmony with Amended Final Determination of the Antidumping Duty Investigation and Notice of Second Amended Final Determination” (82 FR 46219), which amends the cash deposit rate for certain firms. 2. Title 19 U.S.C. 1520(a)(4) authorizes refunds prior to liquidation whenever an importer of record declares or it is ascertained that excess duties, fees, charges, or exactions have been deposited or paid. In accordance with 19 U.S.C. 1520(a)(4), CBP is authorized to grant a refund, if requested by the importer, of cash deposits for unliquidated entries of certain passenger vehicle and light truck tires from the PRC from the entities listed in paragraph 4 below which were entered, or withdrawn from warehouse, for consumption during the period 08/06/2015 (date of the ITC final affirmative determination) through 10/04/2017 (the date of publication of the second amended final determination in the Federal Register, as stipulated by the Court's 09/25/2017 Judgment). 3. The refund amount will be calculated by determining the difference between the amount of cash deposits paid as a result of the application of the amended final determination rate and the amount due as a result of the application of the second amended final determination rate. 4.
