The injunction with court number 14-00106 discussed in message number 5005303, dated 01/05/2015, is applicable to entries of curtain wall units that are produced and imported pursuant to a contract to supply a curtain wall (as identified in the administrative scope proceeding ruling for the countervailing duty order on aluminum extrusions from the People's Republic of China (C-570-968), entitled “Final Scope Ruling on Curtain Wall Units that are Produced and Imported Pursuant to a Contract to Supply a Curtain Wall,” dated 03/27/2014) that were imported by Jangho Curtain Wall Americas Co., Ltd. and were entered or withdrawn from warehouse, for consumption on or after 09/07/2010, and that remain unliquidated as of 12/23/2014. Accordingly, until further notice, continue to suspend liquidation of such entries until liquidation instructions are issued. 4c. The injunction with court number 14-00106 discussed in message number 4363302, dated 12/29/2014, is applicable to entries of curtain wall units that are produced and imported pursuant to a contract to supply a curtain wall (as identified in the administrative scope proceeding ruling for the countervailing duty order on aluminum extrusions from the People's Republic of China (C-570-968), entitled “Final Scope Ruling on Curtain Wall Units that are Produced and Imported Pursuant to a Contract to Supply a Curtain Wall,” dated 03/27/2014) that were produced and/or exported by Permasteelisa South China Factory and Permasteelisa Hong Kong Limited, were imported by Permasteelisa North America Corp., and were entered or withdrawn from warehouse, for consumption on or after 01/01/2012, and that remain unliquidated as of 12/23/2014. Accordingly, until further notice, continue to suspend liquidation of such entries until liquidation instructions are issued. 4d. The injunction with court number 14-00304 discussed in message number 5042304, dated 02/11/2015, is applicable to entries which (1) are covered by Aluminum Extrusions from the People's Republic of China: Countervailing Duty Order, 76 FR 30653 (May 26, 2011), (2) were produced/exported by Dongguan Dazhan Metal Co. Ltd. and imported by Capella Sales and Services Ltd., (3) were entered, or withdrawn from warehouse, for consumption on or after 11/28/2011, and (4) remain unliquidated as of 02/06/2015. Accordingly, until further notice, continue to suspend liquidation of such entries until liquidation instructions are issued. 4e. The injunction with court number 16-00128 discussed in message number 6214303, dated 08/01/2016, is applicable to any unliquidated entries of certain fittings and related products for engine cooling systems (i.e., certain fittings for oil coolers, certain fittings for condensers, certain fittings for radiators, a plug for an oil cooler, a mounting pin for an oil cooler, and a fastener for an oil cooler) identified in the administrative scope proceeding of the antidumping and countervailing duty orders on aluminum extrusions from the People's Republic of China (case numbers A-570-967 and C-570-968), entitled “Final Scope Ruling on Adams Thermal Systems' Certain Fittings and Related Products for Engine Cooling Systems,” dated July 11, 2016 that: 1. Were imported from the People's Republic of China to the United States by Adams Thermal Systems, Inc.; 2. Were entered or withdrawn from warehouse, for consumption, on or after September 7, 2010; and 3. That remain unliquidated as of Noon EDT on 07/28/2016. Accordingly, until further notice, continue to suspend liquidation of such entries until liquidation instructions are issued. 4f. Until further notice, continue to suspend liquidation of the following entries until liquidation instructions are issued: certain kitchen appliance door handles from the PRC imported by Meridian Products LLC entered, or withdrawn from warehouse, for consumption on or after 07/28/2016, as referenced in message number 6285306, dated 10/11/2016. 4g. The injunction with court number 17-00216, discussed in message number 7263302, dated 09/20/2017, is applicable to entries which a) were the subject of Commerce's final determination in Aluminum Extrusions from the People's Republic of China: Affirmative Final Determination of Circumvention of the Antidumping and Countervailing Duty Orders and Rescission of Minor Alterations Anti-Circumvention Inquiry, 82 Fed. Reg. 34,630 (July 26, 2017); and b) were exported from the People's Republic of China by Plaintiff Tai-Ao Aluminium (Taishan) Co., Ltd. and/or imported into the United States by Plaintiff TAAL America Ltd.; and c) were entered, or withdrawn from warehouse, for consumption on or after 03/21/2016. Accordingly, until further notice, continue to suspend liquidation of such entries until liquidation instructions are issued. 5. Additional Liquidation (unless paragraphs 4a, 4b, 4c, 4d, 4e, 4f, or 4g apply): 5a. For entries of certain refrigerator/freezer trim kits from the PRC imported by Meridian LLC (as referenced in message number 6055301 dated 02/24/2016; see also message number 7208307, dated 07/27/2017) which were entered, or withdrawn from warehouse, for consumption during the period 01/01/2016 through 12/31/2016, and not covered by paragraph 3 above, liquidate at the cash deposit rate in effect at the time of entry for the producer and/or exporter, rather than the 0.00 percent cash deposit rate referenced in message number 6055301 dated 02/24/2016. 5b. For entries subject to Commerce's final affirmative determination of circumvention of the countervailing duty order on aluminum extrusions from the PRC (82 FR 34630, dated 07/26/2017) (see message 7223305, dated 08/11/2017) which were entered, or withdrawn from warehouse, for consumption during the period 03/21/2016 through 12/31/2016 and not covered by paragraph 3 above or paragraphs 5c or 5d below, liquidate at the deposit rate in effect at the time of entry for the producer and/or exporter. Commerce's final affirmative determination of circumvention covered extruded aluminum products from the PRC that meet the chemical specifications for 5050 grade aluminum alloy and are heat-treated, regardless of producer, exporter, or importer. 5c. For entries subject to Commerce's final scope determination, dated 07/20/2017, that ACS-50 aluminum extrusions which Kota International, LTD (Kota) imports are within the scope of the countervailing duty order on aluminum extrusions from the PRC (see message 7228305, dated 08/16/2017) which were entered, or withdrawn from warehouse, for consumption during the period 03/21/2016 through 12/31/2016 and not covered by paragraph 3 above, liquidate at the deposit rate in effect at the time of entry for the producer and/or exporter. Commerce's final affirmative scope ruling covered Kota's ACS-50 aluminum extrusions that are heat-treated extruded aluminum products meeting the chemical specifications for 5050 grade aluminum alloy. 5d. For entries subject to Commerce's final scope determination, dated 07/20/2017, that certain products manufactured from 5050 aluminum alloy material (5050 series products) which Trending Imports LLC (Trending) imports are within the scope of the countervailing duty order on aluminum extrusions from the PRC (see message 7228305, dated 08/16/2017) which were entered, or withdrawn from warehouse, for consumption during the period 03/21/2016 through 12/31/2016 and are not covered by paragraph 3 above, liquidate at the deposit rate in effect at the time of entry for the producer and/or exporter. Commerce's final affirmative scope ruling covered Trending's 5050 series products, to the extent such products are heat-treated extruded aluminum, meeting the chemical specifications for 5050 grade aluminum alloy 6. Notices of lifting of suspension: Note to CBP: Please note that there are multiple notices of lifting of suspension dates contained in this message resulting from the number of circumvention and scope determinations recently issued in this countervailing duty proceeding. 6a. Notice of the lifting of suspension of liquidation of entries of subject merchandise covered by paragraph 2 occurred with the publication of the notice of initiation of administrative review for the 05/2017 anniversary month (82 FR 31292, 07/06/2017). Unless instructed otherwise, for all other shipments of aluminum extrusions from the People's Republic of China you shall continue to collect cash deposits of estimated countervailing duties for the merchandise at the current rates. 6b. Notice of the lifting of suspension of liquidation of entries of subject merchandise covered by paragraph 5a occurred on 07/18/2017 (publication of Notice of Second Amended Final Scope Ruling Pursuant to Court Decision). Unless instructed otherwise, for all other shipments of aluminum extrusions from the People's Republic of China you shall continue to collect cash deposits of estimated countervailing duties for the merchandise at the current rates. 6c. Notice of the lifting of suspension of liquidation of entries of subject merchandise covered by paragraph 5b occurred on 07/26/2017 (the date of publication of the Affirmative Final Determination of Circumvention). Unless instructed otherwise, for all other shipments of aluminum extrusions from the People's Republic of China you shall continue to collect cash deposits of estimated countervailing duties for the merchandise at the current rates. 6d. These instructions constitute notice of the lifting of suspension of liquidation of entries of subject merchandise covered by paragraphs 5c and 5d. Accordingly, notice of the lifting of suspension occurred on the message date of these instructions.
