Notice of second amended final scope ruling for refrigerator/freezer trim kits from the People s Republic of China imported by Meridian Products LLC (C-570-968)

1. 03/28/2017, the Court of Appeals for the Federal Circuit (Federal Circuit or CAFC) reversed the Court of International Trade (CIT) and sustained the Department of Commerce's (Department) original scope ruling in which it found that Meridian Products LLC's (Meridian) refrigerator/freezer trim kits did not satisfy the finished goods kit exclusion under the antidumping (AD) and countervailing duty (CVD) orders covering aluminum extrusions from the People's Republic of China (PRC). As a result, Commerce published in the Federal Register 82 FR 32788 on 07/18/2017, with an effective date of 07/18/2017, Notice of Second Amended Final Scope Ruling Pursuant to Court Decision. 2. As a result of the CAFC's final decision, certain refrigerator/freezer trim kits from the PRC imported by Meridian Products LLC described below are covered by the scope of the countervailing duty order on aluminum extrusions from the PRC. CBP is directed to continue to suspend liquidation of the entries of certain refrigerator/freezer trim kits from the PRC imported by Meridian described below entered, or withdrawn from warehouse, for consumption on or after 07/18/2017 at the cash deposit rate in effect at the time of entry of the producer and/or exporter of the refrigerator/freezer trim kits. The trim kits consist of three different styles of aluminum trim kit packages which are utilized as an aesthetic frame around the perimeter of (though not attached to) a major home appliance kitchen appliance, such as a refrigerator. The products at issue are intended to enhance the appearance of the cabinetry surrounding appliances in consumers' homes and lend a customized, “built-in” look. The major appliances units for which the trim packages apply are stand alone freezers, stand alone refrigerators, and freezer plus refrigerators. 3. These cash deposit requirements will remain in effect until further notice. 4.
