1. On 08/26/2016, the U.S. Court of International Trade (CIT) sustained the Final Redetermination issued by Commerce pursuant to Whirlpool Corp. v. United States, (CIT No. 14-00199). As a result, Commerce published in the Federal Register (81 FR 66259) on 09/27/2016, with an effective date of 09/05/2016, the Notice of Court Decision Not in Harmony With Final Scope Ruling and Notice of Amended Final Scope Ruling Pursuant to Court Decision. 2. As a result of the CIT's final decision, certain kitchen appliance door handles from the People's Republic of China (PRC) imported by Whirlpool Corporation (Whirlpool) described below are outside of the scope of the antidumping duty order on aluminum extrusions from the PRC. However, CBP is directed to continue to suspend liquidation of the entries of certain kitchen appliance door handles imported by Whirlpool described below entered, or withdrawn from warehouse, for consumption on or after 09/05/2016 at a zero cash deposit rate, regardless of the rate in effect at the time of entry, until further instructions are provided The handles at issue consist of alloy 6 series aluminum extrusions. The non-aluminum components consist of plastic end caps that are attached by metal screws to the handle and the surface of the kitchen appliance door. The handles are ready for attachment to the refrigerator door upon importation. 3. These cash deposit requirements will remain in effect until further notice. 4. Do not liquidate any entries of the merchandise covered by paragraph 2 above until specific liquidation instructions are issued. 5.
