Notice of an amended final scope ruling for certain kitchen appliance door handles from the People's Republic of China imported by Meridian Products LLC (C-570-968)

Plain-English explanation

CSMS 6285306 is a U.S. Customs and Border Protection (CBP) Cargo Systems Messaging Service bulletin (trade policy), published on October 11, 2016. It carries the official CBP guidance brokers and importers must follow for the topic — "Notice of an amended final scope ruling for certain kitchen appliance door handles from the People's Republic of China imported by Meridian Products LLC (C-570-968)". It links to 1 AD/CVD case in Tandom's catalog. CSMS messages are the operational layer between Commerce determinations and at-the-border collections: when Commerce publishes a new rate, scope ruling, or instruction, CBP turns it into a CSMS that ACE/ACS systems and brokers act on.

1. On 07/18/2016, the U.S. Court of International Trade (CIT) sustained the Final Redetermination issued by Commerce pursuant to Meridian Products LLC v. United States (CIT No. 13-00246). As a result, Commerce published in the Federal Register (81 FR 52402) on 08/08/2016, with an effective date of 07/28/2016, the Notice of Court Decision Not in Harmony With Final Scope Ruling and Notice of Amended Final Scope Ruling Pursuant to Court Decision. 2. As a result of the CIT's final decision, certain kitchen appliance door handles from the People's Republic of China (PRC) imported by Meridian Products LLC (Meridian) described below are outside of the scope of the countervailing duty order on aluminum extrusions from the PRC. However, CBP is directed to continue to suspend liquidation of the entries of certain kitchen appliance door handles from the PRC imported by Meridian described below entered, or withdrawn from warehouse, for consumption on or after 07/28/2016 at a zero cash deposit rate, regardless of the rate in effect at the time of entry, until further instructions are provided. The specific kitchen appliance door handles subject to these instructions are Meridian's “Type B” handles for attachment to ovens, refrigerators or freezers. The “Type B” handles are made of aluminum extrusions, plus two plastic injection molded end caps at each end of the handle. The end caps are used to fasten the handle to the door of the appliance. Holes are drilled in the handles. 3. These cash deposit requirements will remain in effect until further notice. 4. Do not liquidate any entries of the merchandise covered by paragraph 2 above until specific liquidation instructions are issued. 5. If there are any questions by the importing public regarding this message, please contact the Call Center for the Office of AD/CVD Operations, Enforcement and Compliance, International Trade Administration, U.S. Department of Commerce at (202) 482-0984. CBP ports should submit their inquiries through authorized CBP channels only. (This message was generated by OIII: JRT.) 6. There are no restrictions on the release of this information. Yes — for at-the-border filing and entry collection. CSMS messages translate Commerce's Federal Register determinations into operational CBP instructions that ACE/ACS systems and brokers execute. The Federal Register notice is the underlying legal authority; the CSMS is the operational implementation. Both should be read together when reconciling a rate or scope change.
