CSMS # 62050981 - Delay in ACE Automation of De Minimis $ 800 Threshold U.S. Customs and Border Protection sent this bulletin at 09/03/2024 04:22 PM EDT   Cargo Systems Messaging Service CSMS # 62050981 - Delay in ACE Automation of De Minimis $ 800 Threshold U.S. Customs and Border Protection (CBP) previously announced a scheduled September 28, 2024, deployment for functionality related to the enforcement of the statutory requirement of shipments requesting administrative exemption under 19 USC 1321 of an aggregate $ 800. CBP received input from the trade community and based on their feedback, the ACE deployment of the automated rejection of de minimis shipments once the $ 800 per person/per day threshold will be delayed.  On January 11, 2025, CBP will deploy functionality that provides a warning flag to filers when a shipment may exceed the administrative exemption. CBP will continue efforts to deploy the functionality to automatically reject the ineligible shipments and will deploy that functionality no sooner than 30 days from the warning flag deployment.  The Agency will work with the trade community to ensure the process and automation does not impact the flow of legitimate goods. With the significant and ongoing challenges with respect to enforcement in the de minimis environment, it is critical that CBP continue to craft the ACE development to automate enforcement of the “$ 800 per person/per day” eligibility criteria for shipments accorded a duty exemption under 19 U.S.C. § 1321(a)(2)(C). CBP is committed to ensuring that the automation does not negatively impact the efficient flow of goods through U.S. ports of entry.
