CSMS # 60491355 - Correction to CSMS 60478562: REMINDER: Antidumping and Countervailing Duties effective on June 6, 2024, for Solar Cells and Modules from Cambodia, Malaysia, Thailand, and Vietnam U.S. Customs and Border Protection sent this bulletin at 05/07/2024 10:20 AM EDT   Cargo Systems Messaging Service CSMS # 60491355 - Correction to CSMS 60478562 : REMINDER: Antidumping and Countervailing Duties effective on June 6, 2024, for Solar Cells and Modules from Cambodia, Malaysia, Thailand, and Vietnam This message r eplaces CSMS #60478562 that was issued yesterday, May 6, 2024, and has since been deleted. REMINDER: Antidumping and Countervailing Duties are required on imports of solar cells and modules from Cambodia, Malaysia, Thailand, and Vietnam as of June 6, 2024. On August 23, 2023, the Commerce Department published the F inal Scope Determination and Final Affirmative Determinations of Circumvention with Respect to Cambodia, Malaysia, Thailand, and Vietnam relating to the Antidumping and Countervailing Duty Orders on Crystalline Silicon Photovoltaic Cells, Whether or Not Assembled Into Modules, From the People's Republic of China  ( 88 FR 57419 ). This is a reminder to importers that as of June 6, 2024, the date of termination of Presidential Proclamation 10414, antidumping and countervailing duties are required on imports of solar cells and modules from Cambodia, Malaysia, Thailand, and Vietnam that do not meet the certification requirements for these imports.  Any previous entries that entered after November 15, 2022, and before the date of termination (June 6, 2024), that are not utilized (used or installed) by the December 03, 2024, utilization expiration date (180 days after June 6, 2024) will be subject to the antidumping and countervailing (AD/CVD) duties established by the Department of Commerce. Merchandise which remains in inventory or a warehouse in the United States, is resold to another party, is subsequently exported, or is destroyed after importation is not considered utilized. This is a reminder that importers should be prepared to document to U.S. Customs and Border Protection, upon request, whether “applicable entries” entering during the specified period were used or installed in the United States by the utilization expiration date of December 3, 2024. If subject imports are entered without the payment of the cash deposit of antidumping and countervailing duties, and do not meet the utilization requirements, importers should file a post summary correction with the AD/CVD cash deposit.  For entries beyond the post summary correction timeline, importers may file a prior disclosure. This is also a reminder that importers are required to file on a timely basis in the Document Imaging System the certifications required by Commerce’s Final Determination.
