CSMS # 58546756 - Update to National Marine Fisheries Service (NMFS) Seafood Import Monitoring Program (SIMP) U.S. Customs and Border Protection sent this bulletin at 11/29/2023 09:40 AM EST   Cargo Systems Messaging Service CSMS # 58546756 - Update to National Marine Fisheries Service (NMFS) Seafood Import Monitoring Program (SIMP) The National Defense Authorization Act (NDAA) of FY23 (Section 11331(b)) directed the National Marine Fisheries Service (NMFS) to prohibit aggregated harvest reports of Northern Red Snapper under the Seafood Import Monitoring Program (SIMP), regardless of vessel size, no later than one year after enactment. In response, NMFS is preparing to enforce such restrictions by limiting the use of the small-vessel accommodation for Northern Red Snapper (Lutjanus campechanus) when submitting PGA message set data for SIM in the U.S. Customs and Border Protection (CBP) Automated Commercial Environment (ACE). The HTS codes applicable to this import restriction are: 0302895058 (Snapper, Lutjanidae) and 0303890067 (Other, Snapper, Lutjanidae spp.). When submitting PGA message set data for SIM, the PG06 Source Type Code for small-vessel harvest (SVH) will not be permitted when the PG05 species code for SNR (Northern Red Snapper) or SNX (Snappers nei) is declared. Source Type Codes for wild-capture harvests (HCF) and aquaculture (HBA) will be permitted for the species codes.  This update is expected to be deployed in the ACE Certification no earlier than December 20, 2023, and in ACE Production no earlier than January 20, 2024 to provide sufficient time for testing and prevent disruptions to trade. A subsequent CSMS will be issued when testing in CERT is available and to confirm the Production date. NMFS will also publish an updated Implementation Guide with the changes.
