GUIDANCE: EU Steel Limit Modifications for HTS 7301.10.0000 Goods of Germany and Luxembourg

Plain-English explanation

CSMS 54150705 is a U.S. Customs and Border Protection (CBP) Cargo Systems Messaging Service bulletin (operational), published on November 28, 2022. It carries the official CBP guidance brokers and importers must follow for the topic — "GUIDANCE: EU Steel Limit Modifications for HTS 7301.10.0000 Goods of Germany and Luxembourg". CSMS messages are the operational layer between Commerce determinations and at-the-border collections: when Commerce publishes a new rate, scope ruling, or instruction, CBP turns it into a CSMS that ACE/ACS systems and brokers act on.

CSMS # 54150705 - GUIDANCE: EU Steel Limit Modifications for HTS 7301.10.0000 Goods of Germany and Luxembourg U.S. Customs and Border Protection sent this bulletin at 11/28/2022 10:40 AM EST   Cargo Systems Messaging Service CSMS # 54150705 - GUIDANCE: EU Steel Limit Modifications for HTS 7301.10.0000 Goods of Germany and Luxembourg On November 25, 2022 the Department of Commerce updated two limits for the European Union Steel Tariff Rate Quota (TRQ) Program effective November 30, 2022 to align with production capabilities in Germany and Luxembourg. The effected steel HTS is 7301.10.0000 “Sheet Piling” under Chapter 99 HTS 9903.81.13. The quantity formerly listed for Country of Origin Germany has been reassigned to the quota limit for Country of Origin Luxembourg effective November 30, 2022.  The annual EU TRQ thresholds are not impacted by this change.  Section 232 steel products from the EU that are in-quota will enter free of any Section 232 duty.  For more details on the TRQ, consult  https://www.cbp.gov/trade/quota/bulletins . All steel article imports from the EU in excess of the TRQ quantities shall remain subject to the 25 percent ad valorem duty rate imposed by HTSUS subheading 9903.80.01, provided they are not subject to an exclusion.  Steel imports from the European Union must be melted and poured in a member country of the European Union to be eligible for the TRQ.  Additional details on the melt and pour requirement will be provided when they are available. Please visit the Department of Commerce Section 232 details website https://www.bis.doc.gov/index.php/232-steel to review the changes. Listings under “Section 232 EU Agreement Supporting Documents” were updated as follows: Germany and Luxembourg “Sheet Piling” limits are updated in the Steel TRQ by Country Listing document. Germany and Luxembourg “Sheet Piling” limits are updated in the Steel TRQ by Category Listing document. Entries made after 12:01 am local port time on November 30, 2022 will count toward the updated quarterly limits. This change is permanent going forward for the duration of the Section 232 EU TRQ Program. Frequently asked questions

What is CSMS 54150705?

CSMS 54150705 is a U.S. Customs and Border Protection (CBP) Cargo Systems Messaging Service bulletin titled "GUIDANCE: EU Steel Limit Modifications for HTS 7301.10.0000 Goods of Germany and Luxembourg". CSMS bulletins are the operational instructions CBP issues to brokers, importers, and ACE filers covering rate changes, system updates, scope guidance, and other day-to-day customs-operations changes.

When was CSMS 54150705 published?

CBP published CSMS 54150705 on November 28, 2022. The bulletin's instructions are typically operative as of the publication date unless the body specifies a different effective date.

Is the CBP CSMS the legally binding instruction?

Yes — for at-the-border filing and entry collection. CSMS messages translate Commerce's Federal Register determinations into operational CBP instructions that ACE/ACS systems and brokers execute. The Federal Register notice is the underlying legal authority; the CSMS is the operational implementation. Both should be read together when reconciling a rate or scope change.
