Final results of administrative review 2013-2014 – low enriched uranium from France (A-427-818)

This is an informational message for CBP. No action is required. 1. On 09/14/2015, Commerce published in the Federal Register (80 FR 55089) its final results of its administrative review of the antidumping duty (AD) order on low enriched uranium (LEU) from France (A-427-818) for the period 02/01/2013 through 01/31/2014. 2. LEU shipments are excluded from the scope of the AD order on LEU from France if they are owned by a foreign utility end-user and imported into the United States solely for the purpose of conversion or fabrication into fuel assemblies (i.e., fuel rods), so long as such fuel assemblies (1) remain in the possession and control of the U.S. fabricator, the foreign end-user, or their designated transporter while in U.S. customs territory, (2) are exported within 18-months of entry of the LEU, for consumption by the end-user in a nuclear reactor outside the United States, and 3) the importer provides the requisite certifications, from itself and the end-user, to CBP at the time of entry (see message number 2051201, dated 02/20/2002, paragraphs 2, 5, and 6 and message number 5258303, dated 09/15/2015). 3. As a result of the 2013-2014 administrative review Commerce has determined that entries of merchandise exported by AREVA/EURODIF consisting entirely of samples (for testing purposes) of the LEU that is being imported for processing and re-export (as discussed in paragraph 2 above) are also excluded from the scope of the AD order on LEU from France. A shipment consisting entirely of samples of LEU used for testing may not exceed, in total, one kilogram of enriched uranium hexafluoride in weight. Accordingly, such shipments are eligible for entry under case number A-427-818-002 at a zero cash deposit rate. Do not liquidate any entries of merchandise covered by this review until liquidation instructions are issued. 4. Entry summaries covering entries from AREVA/EURODIF consisting entirely of samples of LEU used for testing, as described in paragraph 3 above must be accompanied by a certification from the importer as follows: Certification that Entry is a Certain Type of Sample for Testing. We, the undersigned importer, hereby certify as follows: A) The accompanying entry of enriched uranium hexafluoride is a sample imported by us for purposes of testing of future entries of enriched uranium hexafluoride for conversion by (insert name of fabricator) into uranium dioxide and/or testing of future entries of enriched uranium hexafluoride for fabrication by (insert name of fabricator) into nuclear fuel assemblies for consumption by (insert name of end-user) in a nuclear reactor outside the United States. (Insert name of importer) certifies that this entry consists entirely of samples used for such testing. B) This enriched uranium hexafluoride, and any uranium products derived therefrom, will (1) remain at all times in our possession and control or in the possession and control of our authorized transporter(s), or in the possession and control of (insert name of fabricator) or their authorized transporter(s), while in the customs territory of the United States and (2) shall not be sold, loaned, swapped, used as loan repayments, or utilized for any purpose other than for testing for conversion into uranium dioxide and/or fabrication into nuclear fuel assemblies by (insert name of fabricator) by (insert name of end-user) outside the United States. C. (Insert name of fabricator) will ensure that all samples of enriched uranium hexafluoride not consumed during testing will be either reprocessed and re-exported from the United States, or destroyed in the United States, within 36 months. We make this certification under penalty of law, including (without limitation) the penalties of 19 U.S.C. Section 1592. 5. Entries from AREVA/EURODIF that meet the conditions for samples detailed in paragraph 3, and accompanied by the importer certification contained in paragraph 4 above, will not require the importer or end-user certifications detailed in messages 2051201 (dated 02/20/2002) and 5258303 (dated 09/15/2015). 6.
