Final affirmative determination of critical circumstances in the countervailing duty investigation of hexamethylenetetramine from India (C-533-933)

On 09/23/2025, Commerce published in the Federal Register (90 FR 45720) its final affirmative countervailing duty determination and final affirmative critical circumstances determination, in part, in the countervailing duty investigation of hexamethylenetetramine from India (C-533-933). 2. The merchandise covered by this investigation is described in message 4311401, dated 11/06/2024. 3. Commerce issued message 5069401, dated 03/10/2025, informing CBP of the affirmative preliminary countervailing duty determination. In its final affirmative countervailing duty determination, Commerce has determined that critical circumstances exist for imports of hexamethylenetetramine from India for the producers and/or exporters below. Accordingly, for imports of subject merchandise entered, or withdrawn from warehouse, for consumption during the period 12/07/2024 through 03/06/2025 (90 days prior to the date of FR publication of the preliminary determination through the day prior to the date of FR publication of the preliminary determination), CBP shall suspend liquidation and collect a cash deposit equal to the percentages of entered value listed below: Producer and/or Exporter: Horizon Chemicals Case number: C-533-933-002 Cash deposit rate: 139.55% Producer and/or Exporter: Micro Labs Ltd. In message 5191404, dated 07/10/2025, CBP was directed to discontinue the suspension of liquidation of entries concerning the countervailing duty investigation of hexamethylenetetramine from India effective 07/05/2025 (the first day after provisional measures in this proceeding have been in place for 120 days). The suspension of liquidation will not be resumed unless and until a final determination on this case is published in the Federal Register by the United States International Trade Commission. 5.
