Creation of third-country case number for active anode material from the People's Republic of China (China) (C-570-195) completed in Japan (C-588-195)

Plain-English explanation

CSMS 5177402 is a U.S. Customs and Border Protection (CBP) Cargo Systems Messaging Service bulletin (trade policy), published on June 26, 2025. It carries the official CBP guidance brokers and importers must follow for the topic — "Creation of third-country case number for active anode material from the People's Republic of China (China) (C-570-195) completed in Japan (C-588-195)". It links to 2 AD/CVD cases in Tandom's catalog. CSMS messages are the operational layer between Commerce determinations and at-the-border collections: when Commerce publishes a new rate, scope ruling, or instruction, CBP turns it into a CSMS that ACE/ACS systems and brokers act on.

This is an informational message. No action is required. 1. AD/CVD orders generally cover products from a particular country. In some cases, however, products from the country subject to the AD/CVD order may undergo completion or assembly in a third country prior to export or sale to the United States. The products may remain subject to the AD/CVD order despite the completion or assembly that occurs in the third country. However, for CBP purposes, the country of origin for such products may be the third country where the completion or assembly occurred. For technical reasons, the country of the AD/CVD case number must match the CBP country of origin in the entry summary documentation. Accordingly, Commerce establishes third country AD/CVD case numbers that match the CBP country of origin for CBP purposes. 2. The merchandise covered by this investigation is active anode material, which is an anode grade graphite material with a graphite minimum purity content of 90 percent carbon by weight, whether containing synthetic graphite, natural graphite, or a blend of synthetic and natural graphite; with or without coating. Subject merchandise may be in the form of powder, dry, liquid, or block form and is covered irrespective of the form in which it enters. Subject merchandise typically has a maximum size of 80 microns when in powder form. Subject merchandise has an energy density of 330 milliamp hours per gram or greater and a degree of graphitization of 80 percent or greater, where graphitization refers to the extent of the graphite crystal structure. Subject merchandise is covered regardless of whether it is mixed with silicon based active materials, e.g., silicon-oxide (SiOx), silicon-carbon (SiC), or silicon, or additives such as carbon black or carbon nanotubes. Subject merchandise is covered regardless of the combination of compounds that comprise the graphite material. Subject merchandise is covered regardless of whether it is imported independently, as part of a compound, in a battery, as a component of an anode slurry, or in a subassembly of a battery such as an electrode. Only the anode grade graphite material is covered when entered as part of a mixture with silicon based active materials, as part of a compound, in a battery, as a component of an anode slurry, or in a subassembly of a battery such as an electrode. Active anode material subject to the investigation may be classified under the Harmonized Tariff Schedule of the United States (HTSUS) subheadings 2504.10.5000 and 3801.10.5000. Subject merchandise may also enter under HTSUS subheadings 2504.10.1000 and 3801.90.0000. The HTSUS subheadings are provided for convenience and customs purposes only. The written description of the scope of the investigation is dispositive. 3. Effective 05/28/2025, Commerce established a third-country case number to allow active anode material completed in Japan to be properly reported as subject to the order on active anode material from China (C-570-195) upon entry. Third Country: Japan Case Number: C-588-195 Producer and/or Exporter: All Others Case Number: C-588-195-000 Cash Deposit Rate: 6.55% Producer and/or Exporter: Panasonic Global Procurement China Co., Ltd.; Panasonic Corporation of China Case Number: C-588-195-001 Cash Deposit Rate: 6.55% The third country AD/CVD case numbers above have been assigned for CBP purposes. 4. If there are any questions by the importing public regarding this message, please contact the Call Center for the Office of AD/CVD Operations, Enforcement and Compliance, International Trade Administration, U.S. Department of Commerce at (202) 482-0984. CBP ports should submit their inquiries through authorized CBP channels only. (This message was generated by OII: GS) 5. There are no restrictions on the release of this information. Alexander Amdur

Frequently asked questions

What is CSMS 5177402?

CSMS 5177402 is a U.S. Customs and Border Protection (CBP) Cargo Systems Messaging Service bulletin titled "Creation of third-country case number for active anode material from the People's Republic of China (China) (C-570-195) completed in Japan (C-588-195)". CSMS bulletins are the operational instructions CBP issues to brokers, importers, and ACE filers covering rate changes, system updates, scope guidance, and other day-to-day customs-operations changes.

When was CSMS 5177402 published?

CBP published CSMS 5177402 on June 26, 2025. The bulletin's instructions are typically operative as of the publication date unless the body specifies a different effective date.

Which AD/CVD cases does CSMS 5177402 affect?

CSMS 5177402 references 2 AD/CVD cases (C-570-195, C-588-195). The links on this page take you to each linked order with its current scope, rates, and history.

Is the CBP CSMS the legally binding instruction?

Yes — for at-the-border filing and entry collection. CSMS messages translate Commerce's Federal Register determinations into operational CBP instructions that ACE/ACS systems and brokers execute. The Federal Register notice is the underlying legal authority; the CSMS is the operational implementation. Both should be read together when reconciling a rate or scope change.
