Creation of third-country case numbers for aluminum wire and cable from the People's Republic of China (China) (A-570-095, C-570-096) assembled and/or completed in the Republic of Korea (Korea) (A-580-095, C-580-096)

Plain-English explanation

CSMS 5083410 is a U.S. Customs and Border Protection (CBP) Cargo Systems Messaging Service bulletin (trade policy), published on March 24, 2025. It carries the official CBP guidance brokers and importers must follow for the topic — "Creation of third-country case numbers for aluminum wire and cable from the People's Republic of China (China) (A-570-095, C-570-096) assembled and/or completed in the Republic of Korea (Korea) (A-580-095, C-580-096)". It links to 4 AD/CVD cases in Tandom's catalog. CSMS messages are the operational layer between Commerce determinations and at-the-border collections: when Commerce publishes a new rate, scope ruling, or instruction, CBP turns it into a CSMS that ACE/ACS systems and brokers act on.

This is an informational message. No action is required. 1. AD/CVD orders generally cover products from a particular country. In some cases, however, products from the country subject to the AD/CVD order may undergo completion or assembly in a third country prior to export or sale to the United States. The products may remain subject to the AD/CVD order despite the completion or assembly that occurs in the third country. However, for CBP purposes, the country of origin for such products may be the third country where the completion or assembly occurred. For technical reasons, the country of the AD/CVD case number must match the CBP country of origin in the entry summary documentation. Accordingly, Commerce establishes third country AD/CVD case numbers that match the CBP country of origin for CBP purposes. 2. The merchandise covered by the AD/CVD orders is aluminum wire and cable, which is defined as an assembly of one or more electrical conductors made from 8000 Series Aluminum Alloys (defined in accordance with ASTM B800), Aluminum Alloy 1350 (defined in accordance with ASTM B230/ B230M or B609/B609M), and/or Aluminum Alloy 6201 (defined in accordance with ASTM B398/B398M), provided that: (1) At least one of the electrical conductors is insulated; (2) each insulated electrical conductor has a voltage rating greater than 80 volts and not exceeding 1000 volts; and (3) at least one electrical conductor is stranded and has a size not less than 16.5 thousand circular mil (kcmil) and not greater than 1000 kcmil. The assembly may: (1) Include a grounding or neutral conductor; (2) be clad with aluminum, steel, or other base metal; or (3) include a steel support center wire, one or more connectors, a tape shield, a jacket or other covering, and/or filler materials. Most aluminum wire and cable products conform to National Electrical Code (NEC) types THHN, THWN, THWN-2, XHHW-2, USE, USE-2, RHH, RHW, or RHW-2, and also conform to Underwriters Laboratories (UL) standards UL-44, UL-83, UL-758, UL- 854, UL-1063, UL- 1277, UL-1569, UL-1581, or UL-4703, but such conformity is not required for the merchandise to be included within the scope. The scope of the AD/CVD orders specifically excludes aluminum wire and cable products in lengths less than six feet, whether or not included in equipment already assembled at the time of importation. The merchandise covered by the AD/CVD orders is currently classifiable under subheading 8544.49.9000 of the Harmonized Tariff Schedule of the United States (HTSUS). Products subject to the scope may also enter under HTSUS subheading 8544.42.9090. The HTSUS subheadings are provided for convenience and customs purposes. The written description of the scope of the AD/CVD orders is dispositive. 3. Effective 10/19/2023, Commerce established third-country case numbers to allow aluminum wire and cable assembled or completed in Korea to be properly reported as subject to the AD/CVD orders on aluminum wire and cable from China (A-570-095, C-570-096) upon entry. See message 5044413, 02/13/2025. Third Country: Korea Case Numbers: A-580-095 and C-580-096 Exporter: Country-Wide Case Number: A-580-095-000 Cash Deposit Rate: 52.79% Producer and/or Exporter: All Others Case Number: C-580-096-000 Cash Deposit Rate: 33.44% The third country AD/CVD case numbers above have been assigned for CBP purposes. 4. If there are any questions by the importing public regarding this message, please contact the Call Center for the Office of AD/CVD Operations, Enforcement and Compliance, International Trade Administration, U.S. Department of Commerce, at (202) 482-0984. CBP ports should submit their inquiries through authorized CBP channels only. (This message was generated by OVII:GHC.) 5. There are no restrictions on the release of this information. CSMS bulletins are the operational instructions CBP issues to brokers, importers, and ACE filers covering rate changes, system updates, scope guidance, and other day-to-day customs-operations changes.

When was CSMS 5083410 published?

CBP published CSMS 5083410 on March 24, 2025. The bulletin's instructions are typically operative as of the publication date unless the body specifies a different effective date.

Which AD/CVD cases does CSMS 5083410 affect?

CSMS 5083410 references 4 AD/CVD cases (A-570-095, A-580-095, C-570-096, C-580-096). The links on this page take you to each linked order with its current scope, rates, and history.

Is the CBP CSMS the legally binding instruction?

Yes — for at-the-border filing and entry collection. CSMS messages translate Commerce's Federal Register determinations into operational CBP instructions that ACE/ACS systems and brokers execute. The Federal Register notice is the underlying legal authority; the CSMS is the operational implementation. Both should be read together when reconciling a rate or scope change.
