CSMS #50833017 - Updates to HTS numbers subject to Section 201 duties to take effect 1/27/2022 U.S. Customs and Border Protection sent this bulletin at 01/26/2022 11:40 AM EST Cargo Systems Messaging Service CSMS #50833017 - Updates to HTS numbers subject to Section 201 duties to take effect 1/27/2022 The modifications made to certain HTS classifications within the HTSUS subject to the Section 201 solar measures are laid out in pages 184-185 of USITC Publication 5240 https://www.usitc.gov/publications/tariff_affairs/pub5240.pdf . The new HTS will maintain the duty treatment with respect to actions pursuant to section 201 of the Trade Act of 1974 under the appropriate U.S. Note provided below and will take effect on January 27, 2022. • Per Annex II, U.S. note 18(c)(i) to subchapter III of chapter 99 is modified by deleting “8541.40.60” and inserting “8541.42.00,” and deleting “8541.40.6025” and inserting “8541.42.0010” in lieu thereof. • Per Annex II, U.S. note 18(f) to subchapter III of chapter 99 is modified by deleting “8541.40.60” and inserting “8541.42.00” in lieu thereof. • Per Annex II, U.S. note 18(g) to subchapter III of chapter 99 is modified by deleting “8541.40.60” and inserting “8541.43.00” in lieu thereof. • Per Annex II, U.S. note 18(g) to subchapter III of chapter 99 is modified by deleting “8541.40.6015” and inserting “8541.43.0010” in lieu thereof. • Per Annex II, U.S. note 18(g) to subchapter III of chapter 99 is modified by deleting “8501.61.00” and inserting “8501.80.10” in lieu thereof. • Per Annex II, U.S. note 18(g) to subchapter III of chapter 99 is modified by deleting “8501.31.80” and inserting “8501.71.00 or 8501.72.10” in lieu thereof. • Per Annex II, U.S. note 18(h) to subchapter III of chapter 99 is modified by deleting “8541.40.60” and inserting “8541.43.00” in lieu thereof. • Importers shall submit the corresponding Chapter 99 HTSUS number for the Section 201 duties when the new 1-97 Chapter HTSUS numbers laid out in Publication 5240 are submitted.
