CSMS #45160485 - Update: Interim Guidance – Immediate Delivery Procedures U.S. Customs and Border Protection sent this bulletin at 12/14/2020 05:22 PM EST Cargo Systems Messaging Service CSMS #45160485 - Update: Interim Guidance – Immediate Delivery Procedures This guidance is an update to the 2017 CSMS 17# 000486, Immediate Delivery Procedures for Using the Document Imaging System (DIS). Immediate Delivery (ID) privileges are provided to the importer or broker on behalf of an importer in accordance with 19 CFR 141.68(c). Merchandise may be released under a special permit for ID in specific instances identified in 19 CFR 142.21 such as importation of (a) goods from contiguous countries (specifically Canada and Mexico); (b) fresh fruits and vegetables; (c) importation by U.S. government agencies; (d) articles of a trade fair; (e) goods subject to quota; (f) goods released from warehouse followed by a warehouse withdrawal for consumption; (g) split shipments; (h) entities shipped unassembled or disassembled on multiple conveyances; and (i) end of year authorization issued by U.S. Customs and Border Protection (CBP) Headquarters. This guidance addresses requests for ID privileges that fall within the categories identified in 19 CFR 142.21(a) through (h). Properly initiated requests for ID are considered approved once the shipment of merchandise is released, unless the request for ID has been denied by CBP. At this time, the Automated Commercial Environment (ACE) is not programmed to process ID requests in Cargo Release nor Entry Summary. Please note, the Cargo Release Immediate Delivery Indicator does not effectively request ID procedures for an entry. Until programming is complete in ACE, importers/brokers must follow the procedures below to properly request ID. Action 1: Submit the request notification for ID via letter to the Center (see letter content in Action 3). Submit a letter to the appropriate Center that the importer is assigned. If the importer is not assigned to a Center, the letter should be submitted to the Center with the assigned commodity. Importers/brokers will submit these letters via email to the Center mailbox. Action 2: Transmit in ACE through these procedures: Certified from Summary (Filing the summary in lieu of entry and summary) If transmitting a summary which certifies for cargo release, filers will establish the desired ID entry date by transmitting the estimated entry date in the summary transmission record 11 position 42-47 (“AE” transmissions - filed certified from summary) prior to release. Filing the entry with a separate summary If transmitting a summary without certifying for cargo or after release, the filer should transmit an estimated entry date in record 11 position 42-47. It is suggested to submit the AE prior to release to prevent system issues. Potential system issues: If the AE is not transmitted and the release date is set, ACE will override the transmitted estimated entry date and will default to the release date. In this situation, the filer may need to request a work ticket to correct the date. All entry summary AE retransmissions will reset the entry date, which will lead to date errors. In this situation, please request a work ticket in order to correct the date. Action 3: Submit the same ID notification letter in Action 1 via the Document Image System (DIS) on every entry requesting ID. Letter Contents The letter requesting ID will identify whether it is a blanket or an individual entry request. The letter needs to include the Broker name and Filer Code, Importer of Record Name and Number, the instance for which ID is requested (19 CFR 142.21a-h), the specific dates in the case of a blanket request and 10-digit Harmonized Tariff Schedule Numbers, if applicable. ID privileges can only be requested prior to or at time of release. Filers will need to ensure that the entry and entry summary dates are correctly transmitted and applied to ensure proper duty calculation. Accordingly, the date of entry under ID may differ from what ACE provides as the default calculated date of entry.
