Notice of final determination in the antidumping duty investigation of frozen warmwater shrimp from Indonesia (A-560-842)

Plain-English explanation

CSMS 4310403 is a U.S. Customs and Border Protection (CBP) Cargo Systems Messaging Service bulletin (trade policy), published on November 5, 2024. It carries the official CBP guidance brokers and importers must follow for the topic — "Notice of final determination in the antidumping duty investigation of frozen warmwater shrimp from Indonesia (A-560-842)". It links to 1 AD/CVD case in Tandom's catalog. CSMS messages are the operational layer between Commerce determinations and at-the-border collections: when Commerce publishes a new rate, scope ruling, or instruction, CBP turns it into a CSMS that ACE/ACS systems and brokers act on.

1. On 10/28/2024, Commerce published in the Federal Register (89 FR 85498) its final affirmative determination of sales at less-than-fair-value in the antidumping duty investigation of frozen warmwater shrimp from Indonesia (A-560-842). 2. The products covered by this investigation are described in message 3325404, dated 11/21/2023. 3. This proceeding has been assigned case number A-560-842. 4a. For imports of frozen warmwater shrimp from Indonesia, CBP shall continue to suspend liquidation of such shipments entered, or withdrawn from warehouse, for consumption on or after 05/30/2024 (date suspension first started). Effective 10/28/2024, CBP shall require, for such entries, a cash deposit equal to the margins for the producers and/or exporters listed below: Producer and/or Exporter: PT First Marine Seafoods/PT Khom Foods Case number: A-560-842-001 Cash deposit rate: 3.90% All Others Case Number: A-560-842-000 Cash Deposit Rate: 3.90% 4b. Commerce found a zero or de minimis antidumping rate on imports of subject merchandise for the producer/exporter combination identified below. Accordingly, CBP is directed not to suspend liquidation of imports of shipments, and not to collect cash deposits, from this producer/exporter combination as it will be excluded from any potential order. Producer: PT Bahari Makmur Sejati Exporter: PT Bahari Makmur Sejati Case Number: A-560-842-002 This exclusion from suspension of liquidation does not apply to entries of merchandise: (i) Produced by PT Bahari Makmur Sejati that is exported by any company other than PT Bahari Makmur Sejati; (ii) Exported by PT Bahari Makmur Sejati that is produced by any company other than PT Bahari Makmur Sejati; or (iii) Exported by a company that sourced from this excluded combination. Accordingly, such merchandise should be entered under the case number and cash deposit rate for the appropriate company (or all others) under the sub-paragraph(s) above. 5. If any entries of this merchandise are exported by a firm other than the producer, then the following instructions apply: A. If the exporter of the subject merchandise does not have its own rate but the producer has its own rate, the cash deposit rate will be the producer's rate. B. Where neither the exporter nor the producer currently has its own rate or the producer is unknown, use the all-others rate of 3.90 percent to establish the cash deposit rate. 6. If there are any questions by the importing public regarding this message, please contact the Call Center for the Office of AD/CVD Operations, Enforcement and Compliance, International Trade Administration, U.S. Department of Commerce at (202) 482-0984. CBP ports should submit their inquiries through authorized CBP channels only. (This message was generated by OV: MB.) 7. There are no restrictions on the release of this information. Alexander Amdur

Yes — for at-the-border filing and entry collection. CSMS messages translate Commerce's Federal Register determinations into operational CBP instructions that ACE/ACS systems and brokers execute. The Federal Register notice is the underlying legal authority; the CSMS is the operational implementation. Both should be read together when reconciling a rate or scope change.
