Gap period liquidation instructions for the antidumping duty investigation on certain paper shopping bags from Taiwan for the period 07/01/2024 through 07/09/2024 (A-583-872)

This instruction constitutes the notice of lifting of suspension of liquidation (see paragraph 5 below). 1. In accordance with section 733(d) of the Tariff Act of 1930, as amended, Commerce shall order the suspension of liquidation of entries of merchandise subject to an antidumping duty investigation and shall order the collection of estimated duties for a temporary period (the provisional-measures period). When entries of subject merchandise continue to be suspended after the expiration of the provisional-measures period, Commerce must instruct CBP to terminate suspension and liquidate entries without regard to antidumping duties on such merchandise. 2. 06/30/2024 was the final day that provisional measures were in effect in this proceeding for All Others (A-583-872-000) and Juang Jia Guoo Co., Ltd (A-583-872-002); however, suspension of liquidation of entries of subject merchandise may have continued for these companies. Accordingly, for suspended entries of certain paper shopping bags from Taiwan from these companies that were entered, or withdrawn from warehouse, for consumption during the period 07/01/2024 (the day after the final day of provisional measures), through 07/09/2024 (the day prior to publication of the ITC final determination), CBP should terminate the suspension of liquidation and liquidate the entries without regard to antidumping duties (i.e. refund all cash deposits). 3. This instruction to terminate the suspension of liquidation and liquidate entries without regard to duties does not apply to entries that were produced and/or exported by Haur Tyi Paper Bag Co., Ltd (AKA Haurtyi Paper Bag Co.) (A-583-872-003). Accordingly, unless instructed otherwise, continue to suspend liquidation and collect cash deposits of estimated antidumping duties at the current rates for all entries of merchandise that was produced and/or exported by Haur Tyi Paper Bag Co., Ltd (AKA Haurtyi Paper Bag Co.) until specific liquidation instructions are issued. 4. The interest provisions of section 778 of the Tariff Act of 1930, as amended, do not apply. 5. This instruction constitutes notice of the lifting of suspension of liquidation of entries of subject merchandise during the period 07/01/2024 through 07/09/2024. 6.
