Notice of final affirmative determination and critical circumstances in the antidumping duty investigation of grain-oriented electrical steel from Poland (A-455-804)

1. On 07/22/2014, Commerce published in the Federal Register (79 FR 42501) its final affirmative determination of sales at less than fair value and critical circumstances in the antidumping duty investigation of grain-oriented electrical steel from Poland (A-455-804) 2. The product covered by the scope of this investigation is grain-oriented electrical steel. Grain-oriented electrical steel is a flat-rolled alloy steel product containing by weight at least 0.6 percent but not more than 6 percent of silicon, not more than 0.08 percent of carbon, not more than 1.0 percent of aluminum, and no other element in an amount that would give the steel the characteristics of another alloy steel, in coils or in straight lengths. The grain-oriented electrical steel that is subject to this investigation is currently classifiable under subheadings 7225.11.0000, 7226.11.1000, 7226.11.9030, and 7226.11.9060 of the Harmonized Tariff Schedule of the United States (HTSUS). Although the HTSUS subheadings are provided for convenience and customs purposes, the written description of the scope of this investigation is dispositive. Excluded are flat-rolled products not in coils that, prior to importation into the United States, have been cut to a shape and undergone all punching, coating, or other operations necessary for classification in Chapter 85 of the HTSUS as a transformer part (i.e., laminations). 3. This investigation has been assigned investigation number A-455-804. 4. Commerce determined that critical circumstances exist for imports of grain-oriented electrical steel from Poland with regard to Stalprodukt S.A. and companies receiving the “all others” rate. CBP shall continue to suspend liquidation of such shipments that are entered, or withdrawn from warehouse, for consumption on or after 02/11/2014. Effective 07/22/2014, for such entries, CBP shall require a cash deposit equal to the margins for the producers and/or exporters listed below: Producer and/or Exporter: Stalprodukt S.A. Case number: A-455-804-001 Cash deposit rate: 99.51% All Others Case Number: A-455-804-000 Cash Deposit Rate: 78.10% 5. If any entries of this merchandise are exported by a firm other than the producer, then the following instructions apply: A. If the exporter of the subject merchandise does not have its own rate but the producer has its own rate, the cash deposit rate will be the producer's rate. B. Where neither the exporter nor the producer currently has its own rate or the producer is unknown, use the all-others rate of 78.10 percent to establish the cash deposit rate. 6.
