Notice of affirmative preliminary CVD determination and alignment of the final CVD determination with the AD investigation of frozen warmwater shrimp from Ecuador (C-331-806)

1. On 04/01/2024, Commerce published in the Federal Register its affirmative preliminary determination in the countervailing duty (CVD) investigation of frozen warmwater shrimp (shrimp) from Ecuador (subject merchandise) (89 FR 22379). On 04/25/2024, Commerce published an amendment to the preliminary determination, which changed the cash deposit rates for certain producers and/or exporters. (89 FR 31722). Additionally, Commerce has aligned the deadline for the final determination in the CVD investigation with the deadline for the final determination in the companion antidumping duty investigation of the same merchandise, currently scheduled to be issued no later than 08/05/2024. 2. The merchandise covered by this investigation is described in message 3328404, dated 11/24/2023. 3. This proceeding has been assigned case number C-331-806. 4a. Cash Deposits for the companies identified below. CBP shall suspend liquidation of subject merchandise entered, or withdrawn from warehouse, for consumption on or after 04/01/2024 (the date of publication of the original preliminary determination), and shall require, for such entries, a cash deposit equal to the percentages of entered value for the producers and/or exporters listed below. Producer and/or Exporter: Industrial Pesquera Santa Priscila S.A. and its cross-owned companies: Manesil S.A.; Tropical Packing Ecuador S.A.; Produmar S.A.; and Egidiosa S.A. Case Number: C-331-806-001 Cash Deposit: 2.89 percent Producer and/or Exporter: All Others Case Number: C-331-806-000 Cash Deposit Rate: 2.89 % 4b. Commerce found a zero or de minimis subsidy rate on imports of subject merchandise for the producer/exporter combination identified below. Accordingly, CBP is directed not to suspend liquidation of imports of shipments from these producer/exporter combinations. Case Number: C-331-806-002 Merchandise exported by Sociedad Nacional de Galapagos C.A. and its cross-owned companies Naturisa S.A., Holding Sola & Sola Solacciones S.A., and Empacadora Champmar S.A., that is produced by any company other than Sociedad Nacional de Galapagos C.A. and its cross-owned companies Naturisa S.A., Holding Sola & Sola Solacciones S.A., and Empacadora Champmar S.A., and merchandise produced by Sociedad Nacional de Galapagos C.A. and its cross-owned companies Naturisa S.A., Holding Sola & Sola Solacciones S.A., and Empacadora Champmar S.A., that is exported by any company other than Sociedad Nacional de Galapagos C.A. and its cross-owned companies Naturisa S.A., Holding Sola & Sola Solacciones S.A., and Empacadora Champmar S.A., is not subject to this exclusion from suspension of liquidation. Such merchandise, entered or withdrawn from warehouse, for consumption on or after 04/01/2024, should be entered under case number C-331-806-000 and suspended at the all-others cash deposit rate. 5.
