Notice of preliminary determination and affirmative critical circumstances in the antidumping duty investigation of gas powered pressure washers from the People's Republic of China (A-570-148)

Plain-English explanation

CSMS 4017408 is a U.S. Customs and Border Protection (CBP) Cargo Systems Messaging Service bulletin (trade policy), published on January 17, 2024. It carries the official CBP guidance brokers and importers must follow for the topic — "Notice of preliminary determination and affirmative critical circumstances in the antidumping duty investigation of gas powered pressure washers from the People's Republic of China (A-570-148)". It links to 1 AD/CVD case in Tandom's catalog. CSMS messages are the operational layer between Commerce determinations and at-the-border collections: when Commerce publishes a new rate, scope ruling, or instruction, CBP turns it into a CSMS that ACE/ACS systems and brokers act on.

This is a correction to message 3220407, dated 08/08/2023, to correct paragraphs 4a and 4b. 1. Message 3220407 instructed CBP to collect cash deposits on an exporter basis only. The cash deposit instructions should have instructed CBP to collect cash deposits on a producer/exporter basis. Below is the fully corrected message. 2. On 08/08/2023, Commerce published in the Federal Register (88 FR 51279) its preliminary determination of sales at less than fair value and the postponement of the final determination in the antidumping duty investigation of gas powered pressure washers (pressure washers) from the People's Republic of China (China). 3. The products covered by this investigation are described in message 3025403, dated 01/25/2023. 4. This proceeding has been assigned case number A-570-148. 5a. For imports of pressure washers from China, CBP shall suspend liquidation of such shipments entered, or withdrawn from warehouse, for consumption on or after 05/05/2023, which is 90 days before the date of publication of the preliminary determination in the Federal Register. Effective 05/05/2023, CBP shall require, for entries of pressure washers from country from the exporter/producer combinations listed below, a cash deposit or the posting of a bond equal to the antidumping duty cash deposit(s) shown below: Exporter: China-Wide Entity Case number: A-570-148-000 Cash deposit rate: 263.83% Exporter: Jiangsu Jianghuai Engine Co., Ltd. Producer: Jiangsu Jianghuai Engine Co., Ltd. Case number: A-570-148-001 Cash deposit rate: 252.71% 5b. Because Commerce determined that critical circumstances did not exist for imports of pressure washers from China from the producers/exporters below, CBP shall suspend liquidation of all appropriate entries of pressure washers from China that are entered, or withdrawn from warehouse, for consumption on or after 08/03/2023 (the date of the publication of the preliminary determination). Effective 08/03/2023, for entries of pressure washers from China from the producers/exporters listed below, CBP shall require a cash deposit equal to the following dumping margins: Exporter: Sumec Hardware and Tools Co., Ltd Producer: Sumec Hardware and Tools Co., Ltd Case number: A-570-148-002 Cash deposit rate: 252.71% Exporter: Zhejiang Danau Machine Co., Ltd. Producer: Zhejiang Danau Machine Co., Ltd. Case number: A-570-148-003 Cash deposit rate: 252.71% 6. For all other entries of pressure washers from China, the following cash deposit instructions apply: A. For all Chinese exporters of pressure washers from China which have not received their own rate, the cash deposit rate will be the China-wide rate. B. For all non-Chinese exporters of pressure washers from China which have not received their own rate, the cash deposit rate will be the rate applicable to the exporter/producer combinations that supplied that non-Chinese exporter. 7. If there are any questions by the importing public regarding this message, please contact the Call Center for the Office of AD/CVD Operations, Enforcement and Compliance, International Trade Administration, U.S. Department of Commerce at (202) 482-0984. CBP ports should submit their inquiries through authorized CBP channels only. (This message was generated by OI:HP.) 8. There are no restrictions on the release of this information. Alexander Amdur

Yes — for at-the-border filing and entry collection. CSMS messages translate Commerce's Federal Register determinations into operational CBP instructions that ACE/ACS systems and brokers execute. The Federal Register notice is the underlying legal authority; the CSMS is the operational implementation. Both should be read together when reconciling a rate or scope change.
