Notice of an amended final determination in the antidumping duty investigation of certain corrosion-resistant steel products from Taiwan (A-583-856)

1. On 06/23/2023, the U.S. Court of International Trade issued a final decision in Prosperity Tieh Enterprise Co., Ltd. et. al. v. United States, Court No. 16-00138, Slip Op. 23-95. As a result of this decision, on 08/25/2023, Commerce published in the Federal Register, Corrosion-Resistant Steel Products from Taiwan: Notice of Third Amended Final Determination of Sales at Less Than Fair Value Pursuant to Court Decision and Partial Exclusion from Antidumping Duty Order (88 FR 58245), as corrected by Corrosion-Resistant Steel Products from Taiwan: Notice of Third Amended Final Determination of Sales at Less than Fair Value Pursuant to Court Decision and Partial Exclusion from Antidumping Duty Order; Correction (88 FR 65153, identifying 8/25/2023 as the correct effective date for the preceding notice). This message amends certain instructions pertaining to the final determination in this proceeding. See message 6208305, dated 07/26/2016, amended by message 9063302, dated 03/04/2019. 2. As a result of the CIT's final decision, entries of certain corrosion-resistant steel products (CORE) from Taiwan produced and exported by Yieh Phui Enterprise Co., Ltd. or Synn Industrial Co., Ltd. (A-583-856-004) are excluded from the antidumping duty order. Accordingly, CBP should discontinue suspension of liquidation of imports of shipments from this producer/exporter combination that were entered, or withdrawn from warehouse, for consumption on or after 08/25/2023 (the effective date of the amended final determination). Commerce will issue separate liquidation instructions for entries made prior to the effective date of the amended final determination. 3. The CIT's final decision also results in an amendment to the cash deposit rate for all-other producers and/or exporters except for companies that subsequently received their own rates in the subsequent administrative reviews. Accordingly, effective 08/25/2023 (the effective date of the amended final determination), for shipments of CORE from Taiwan entered, or withdrawn from warehouse, for consumption on or after 08/25/2023, CBP shall require, for such entries, a cash deposit equal to the margin for the producers and/or exporters listed below: All-Others Case Number: A-583-856-000 Cash deposit rate: 11.04% 4. These cash deposit requirements shall remain in effect until further notice. Do not liquidate any entries of this merchandise until specific liquidation instructions are issued. 5. Unless instructed otherwise, for all other shipments of CORE from Taiwan not covered by paragraphs 2 and 3 above, you shall continue to collect cash deposits of estimated antidumping duties for the merchandise at the current rates. 6.
