Creation of third-country case number for Xanthan Gum from the People's Republic of China (A-570-985) completed in Canada (A-122-985)

Plain-English explanation

CSMS 2314401 is a U.S. Customs and Border Protection (CBP) Cargo Systems Messaging Service bulletin (trade policy), published on November 10, 2022. It carries the official CBP guidance brokers and importers must follow for the topic — "Creation of third-country case number for Xanthan Gum from the People's Republic of China (A-570-985) completed in Canada (A-122-985)". It links to 2 AD/CVD cases in Tandom's catalog. CSMS messages are the operational layer between Commerce determinations and at-the-border collections: when Commerce publishes a new rate, scope ruling, or instruction, CBP turns it into a CSMS that ACE/ACS systems and brokers act on.

This is an informational message. No action is required. 1. AD/CVD orders generally cover products from a particular country. In some cases, however, products from the country subject to the AD/CVD order may undergo completion or assembly in a third country prior to export or sale to the United States. The products may remain subject to the AD/CVD order despite the completion or assembly that occurs in the third country. However, for CBP purposes, the country of origin for such products may be the third country where the completion or assembly occurred. For technical reasons, the country of the AD/CVD case number must match the CBP country of origin in the entry summary documentation. Accordingly, Commerce establishes third country AD/CVD case numbers that match the CBP country of origin for CBP purposes. 2. The merchandise covered by this order is dry xanthan gum, whether or not coated or blended with other products. Further, xanthan gum is included in this order regardless of physical form, including, but not limited to, solutions, slurries, dry powders of any particle size, or unground fiber. Xanthan gum that has been blended with other product(s) is included in this scope when the resulting mix contains fifteen percent or more of xanthan gum by dry weight. Other products with which xanthan gum may be blended include, but are not limited to, sugars, minerals, and salts. Xanthan gum is a polysaccharide produced by aerobic fermentation of Xanthomonas campestris. The chemical structure of the repeating pentasaccharide monomer unit consists of a backbone of two P-1,4-D-Glucose monosaccharide units, the second with a trisaccharide side chain consisting of P-D-Mannose-(1,4) - P-DGlucuronic acid-(1,2) -a-D-Mannose monosaccharide units. The terminal mannose may be pyruvylated and the internal mannose unit may be acetylated. Merchandise covered by the scope of this order is classified in the Harmonized Tariff Schedule (HTS) of the United States at subheading 3913.90.20. This tariff classification is provided for convenience and customs purposes; however, the written description of the scope is dispositive. 3. On 10/25/2022, Commerce established a third-country case number to allow xanthan gum completed in Canada to be properly reported as subject to the order on xanthan gum from the People's Republic of China (A-570-985) upon entry. Third Country: Canada Case Number: A-122-985 Exporter: Country-Wide Case Number: A-122-985-000 Cash Deposit Rate: 154.07% The third country AD case number above has been assigned for CBP purposes. 4. If there are any questions by the importing public regarding this message, please contact the Call Center for the Office of AD/CVD Operations, Enforcement and Compliance, International Trade Administration, U.S. Department of Commerce at (202) 482-0984. CBP ports should submit their inquiries through authorized CBP channels only. (This message was generated by O4:RA) 5. There are no restrictions on the release of this information. Alexander Amdur

CSMS 2314401 is a U.S. Customs and Border Protection (CBP) Cargo Systems Messaging Service bulletin titled "Creation of third-country case number for Xanthan Gum from the People's Republic of China (A-570-985) completed in Canada (A-122-985)". CSMS bulletins are the operational instructions CBP issues to brokers, importers, and ACE filers covering rate changes, system updates, scope guidance, and other day-to-day customs-operations changes.

When was CSMS 2314401 published?

CBP published CSMS 2314401 on November 10, 2022. The bulletin's instructions are typically operative as of the publication date unless the body specifies a different effective date.

Which AD/CVD cases does CSMS 2314401 affect?

Is the CBP CSMS the legally binding instruction?

Yes — for at-the-border filing and entry collection. CSMS messages translate Commerce's Federal Register determinations into operational CBP instructions that ACE/ACS systems and brokers execute. The Federal Register notice is the underlying legal authority; the CSMS is the operational implementation. Both should be read together when reconciling a rate or scope change.
