1. On 08/25/2022, the U.S. Court of International Trade (CIT) sustained the Final Redetermination issued by Commerce pursuant to Saha Thai Steel Pipe Public Company, Ltd., v. United States (Ct. No. 20-00133). As a result, Commerce published in the Federal Register (87 FR 54977) on 09/08/2022, with an effective date of 09/04/2022, the Notice of Court Decision Not in Harmony With Final Scope Ruling and Notice of Amended Final Scope Ruling Pursuant to Court Decision. 2. Although, as a result of the CIT's final decision, dual stenciled pipe which was produced and/or exported by Saha Thai Steel Pipe Public Company, Ltd. (Saha Thai) is outside the scope of the order on circular welded carbon steel pipes and tubes from Thailand, CBP is directed to suspend or continue to suspend liquidation of all entries of Saha Thai dual stenciled pipe entered, or withdrawn from warehouse, for consumption on or after 09/04/2022. For purposes of this scope ruling, dual stenciled pipe is defined as having an outside diameter of 0.375 inches or more, but not exceeding 16 inches, of any wall thickness. Such pipe is dual-stenciled as both "standard pipe" and "line pipe," i.e., identified to indicate compliance with two different industry specifications, as conforming to industry standards for both standard pipe and line pipe, such as ASTM A53 and API 5L. 3. As a result of the CITs final decision, a cash deposit rate of zero is applicable to entries identified in paragraph 2 above. These cash deposit requirements will remain in effect until further notice. 4. Because the revised cash deposit rate is to be applied retroactively to entries made on or after 09/04/2022, Commerce will issue instructions for granting a refund on any overcollection in a separate message. 5.
