Correction of message 2021401: Re: Notice of an amended final determination in the investigation and revocation of the countervailing duty order on utility scale wind towers from Indonesia (C-560-834)

1. This is a correction to message 2021401, dated 01/21/2022, to correct paragraph 2 of that message. 2. Paragraph 2 of message 2021401contains incorrect information about the date on which CBP should continue to suspend liquidation of entries of utility scale wind towers from Indonesia entered, or withdrawn from warehouse, at a zero cash deposit rate. The date entered was 01/07/2021, but should be changed to 01/07/2022. Below is the fully corrected message. 3. On 12/28/2021, the U.S. Court of International Trade (CIT) sustained the Final Redetermination issued by Commerce pursuant to PT. Kenertec Power System v. United States (Slip Op. 21-175, CIT No. 20-03687). As a result, Commerce published in the Federal Register (87 FR 2137) on 01/13/2022, with an effective date of 01/07/2022, the Notice of Court Decision Not in Harmony with Final Affirmative Countervailing Duty Determination, Notice of Amended Final Determination, and Notice of Revocation of Countervailing Duty Order. 4. As a result of the CIT's final decision, Commerce is revoking the order on utility scale wind towers from Indonesia. However, the Wind Tower Trade Coalition has 60 days to appeal the CIT's decision to the U.S. Court of Appeals for the Federal Circuit, and therefore suspension of liquidation must continue during the pendency of the appeals process. Accordingly, CBP is directed to continue to suspend liquidation of the entries of utility scale wind towers from Indonesia entered, or withdrawn from warehouse, for consumption on or after 01/07/2022 at a zero cash deposit rate. 5. Because the revised cash deposit rate is to be applied retroactively to entries made on or after 12/13/2019, Commerce will issue instructions for granting a refund on any over collection in a separate message. 6. These cash deposit requirements will remain in effect until further notice. 7. Do not liquidate any entries of the merchandise covered by paragraph 4 above until specific liquidation instructions are issued. 8.
