1. On 05/22/2020, the U.S. Court of International Trade (CIT) sustained the remand redetermination issued by Commerce pursuant to Borusan Mannesmann Boru Sanayi ve Ticaret A.S. v. United States (CIT Consol. Court No. 19-00056). As a result, Commerce published in the Federal Register (85 FR 35262) on 06/09/2020, with an effective date of 06/01/2020, Large Diameter Welded Pipe from the Republic of Turkey: Notice of Court Decision Not in Harmony with Amended Final Determination in the Less-Than-Fair-Value Investigation; Notice of Amended Final Determination Pursuant to Court Decision; and Notice of Revocation of Antidumping Duty Order, in Part. 2. As a result of the CIT's final decision, large diameter welded pipe from the Republic of Turkey, produced and exported by Borusan Mannesmann Boru Sanayi ve Ticaret A.S. is being excluded from the antidumping duty order on large diameter welded pipe from the Republic of Turkey. Accordingly, CBP is directed to suspend or continue to suspend liquidation of the entries of large diameter welded pipe from the Republic of Turkey, produced and exported by Borusan Mannesmann Boru Sanayi ve Ticaret A.S. (A-489-833-001) and entered, or withdrawn from warehouse, for consumption on or after 06/01/2020 at a zero cash deposit rate pending the final outcome of the litigation. 3. Also as a result of the CIT's final decision, CBP is directed to continue to suspend liquidation of entries of large diameter welded pipe from Turkey that were entered, or withdrawn from warehouse, for consumption on or after 06/01/2020 and collect a cash deposit equal to the percentage of entered value for the producers and/or exporters listed below: Producer and/or Exporter: HDM Celik Boru Sanayi ve Ticaret A.S. Case Number: A-489-833-002 Cash Deposit Rate: 1.57 percent Producer and/or Exporter: All Others Case Number: A-489-833-000 Deposit Rate: 1.57 percent 4. Because the revised cash deposit rate is to be applied to entries made on or after 06/01/2020, Commerce will issue instructions for granting a refund on any over collection for shipments entered, or withdrawn from warehouse, for consumption or after 06/01/2020 through the date of this message in a separate message. 5. These cash deposit requirements will remain in effect until further notice. 6. Do not liquidate any entries of the merchandise covered by paragraphs 2 and 3 above until specific liquidation instructions are issued. 7.
