CASH DEPOSIT INSTRUCTIONS FOR PASTA

Plain-English explanation

CSMS 0092301 is a U.S. Customs and Border Protection (CBP) Cargo Systems Messaging Service bulletin (trade policy), published on April 2, 2010. It carries the official CBP guidance brokers and importers must follow for the topic — "CASH DEPOSIT INSTRUCTIONS FOR PASTA". CSMS messages are the operational layer between Commerce determinations and at-the-border collections: when Commerce publishes a new rate, scope ruling, or instruction, CBP turns it into a CSMS that ACE/ACS systems and brokers act on.

1. COMMERCE HAS PUBLISHED IN THE FEDERAL REGISTER (75 FR 11116) ON 03/10/2010 THE AMENDED FINAL RESULTS OF ITS ADMINISTRATIVE REVIEW OF CERTAIN MANUFACTURERS/EXPORTERS SUBJECT TO THE ANTIDUMPING ORDER ON PASTA FROM ITALY FOR THE PERIOD 07/01/2007 THROUGH 06/30/2008. 2. AS A RESULT OF COMMERCE'S REVIEW, THE CASH DEPOSIT RATES HAVE BEEN REVISED FOR CERTAIN MANUFACTURERS AND/OR EXPORTERS. THEREFORE, FOR SHIPMENTS OF PASTA FROM ITALY ENTERED, OR WITHDRAWN FROM WAREHOUSE, FOR CONSUMPTION ON OR AFTER MARCH 10, 2010, THE REQUIRED CASH DEPOSIT HAS BEEN REVISED FOR THE MANUFACTURERS/EXPORTERS LISTED IN THE COMPANY DETAILS SECTION OF THIS MESSAGE. 3. IF ANY ENTRIES OF MERCHANDISE ARE EXPORTED BY A FIRM OTHER THAN THE MANUFACTURER, THEN THE FOLLOWING INSTRUCTIONS APPLY: A. IF THE EXPORTER OF THE SUBJECT MERCHANDISE HAS ITS OWN RATE, USE THE EXPORTER'S RATE TO DETERMINE THE CASH DEPOSIT RATE. B. IF THE EXPORTER OF THE SUBJECT MERCHANDISE DOES NOT HAVE ITS OWN RATE, BUT THE MANUFACTURER HAS ITS OWN RATE, THE CASH DEPOSIT RATE WILL BE THE MANUFACTURER'S RATE. C. WHERE NEITHER THE EXPORTER NOR THE MANUFACTURER CURRENTLY HAS ITS OWN RATE OR THE MANUFACTURER IS UNKNOWN, USE THE ‘ALL OTHER' RATE FOR ESTABLISHING THE CASH DEPOSIT RATE. 4. FOR ALL MANUFACTURERS AND/OR EXPORTERS OF PASTA FROM ITALY WITHOUT THEIR OWN RATE, THE CASH DEPOSIT RATE IS 15.45 PERCENT. 5. THESE CASH DEPOSIT REQUIREMENTS SHALL REMAIN IN EFFECT UNTIL FURTHER NOTICE. DO NOT LIQUIDATE ANY ENTRIES OF MERCHANDISE INCLUDED IN THIS ADMINISTRATIVE REVIEW UNTIL ASSESSMENT INSTRUCTIONS ARE RECEIVED. 6. IF THERE ARE ANY QUESTIONS REGARDING THIS MATTER BY CBP OFFICERS, THE IMPORTING PUBLIC OR INTERESTED PARTIES, PLEASE CONTACT DAVINA HASHMI OR RON TRENTHAM AT THE OFFICE OF AD/CVD OPERATIONS, IMPORT ADMINISTRATION, INTERNATIONAL TRADE ADMINISTRATION, U.S. DEPARTMENT OF COMMERCE, AT (202) 482-0984 OR (202) 482-3577, RESPECTIVELY (GENERATED BY O3: VC). 7. Frequently asked questions

What is CSMS 0092301?

CSMS 0092301 is a U.S. Customs and Border Protection (CBP) Cargo Systems Messaging Service bulletin titled "CASH DEPOSIT INSTRUCTIONS FOR PASTA". CSMS bulletins are the operational instructions CBP issues to brokers, importers, and ACE filers covering rate changes, system updates, scope guidance, and other day-to-day customs-operations changes.

When was CSMS 0092301 published?

CBP published CSMS 0092301 on April 2, 2010. The bulletin's instructions are typically operative as of the publication date unless the body specifies a different effective date.

Is the CBP CSMS the legally binding instruction?

Yes — for at-the-border filing and entry collection. CSMS messages translate Commerce's Federal Register determinations into operational CBP instructions that ACE/ACS systems and brokers execute. The Federal Register notice is the underlying legal authority; the CSMS is the operational implementation. Both should be read together when reconciling a rate or scope change.
